About this file
This is an Administrative Charges Schedule exhibit for Volusia County, Florida's Beach Maintenance services contract (RFP #26-P-05MC), which outlines penalties for contractor non-compliance with operational and regulatory requirements across approximately 47 miles of coastal shoreline. The schedule establishes financial penalties ranging from $25 to $1,000 per incident for violations including failure to comply with federal, state, or local regulations; improper waste disposal; unauthorized conservation zone driving; inadequate employee training per the Habitat Conservation Plan; missing vehicle identification; delinquent garbage and recycling can servicing; failure to grade or sweep beach ramps; improper fire ring placement or removal; abandoned equipment non-removal; incomplete nightly rut-raking documentation; and unauthorized pre-7 PM rut-raking activities without Habitat Conservation Plan staff approval. Specific penalty amounts include $1,000 per incident for regulatory non-compliance and improper waste disposal; $500 per incident for spillage cleanup failures and $500 per employee per day for training deficiencies; $100 per vehicle per day for missing contractor identification; $25 per can per day for service schedule failures; $500 per ramp per day for grading or sweeping failures; and $50 per ring per day and $50 to $100 per incident for fire ring and rut-raking violations respectively.
These administrative charges function as liquidated damages separate from any legal fines imposed by federal, state, or local regulatory agencies, establishing clear financial accountability mechanisms to ensure contractor compliance with the comprehensive beach maintenance requirements including ramp maintenance, waste collection from 800 trash cans, bulk debris removal, and sea turtle nesting season rut-raking operations. The penalty structure emphasizes environmental protection, particularly regarding conservation zone access and vegetation preservation, employee training and certification, and adherence to operational schedules critical to coastal resource management and public beach safety.
