D. RUT RAKING
During the summer months, sea turtles emerge from the sea at night, dig nests in the soft sand area, and lay eggs. In approximately two months, sea turtle hatchlings emerge from the nests at night and crawl from the nests toward the sea. In beach driving areas, the hatchlings are susceptible to becoming trapped in tire ruts located between the nest and the sea. During sea turtle nest hatching season, the Contractor will be requested to remove the tire ruts by rut raking in the evening after the beach is closed to public driving.
A schedule of nest locations will be provided ahead of the turtle nests hatching to allow for rut removal activities to be conducted each night before the nest hatches. Rut raking provides hatchlings with a safe, smooth access path to the sea (Exhibit G - Reference Photos).
1. Locations
Rut raking may occur anywhere along the 17 miles of coastline designated for public beach driving and in select natural beach management areas due to construction activity or special circumstances.
2. Frequency
a. Rut raking may be required seven (7) days a week as needed during the designated sea turtle nest hatching season beginning 45 days after the first nest is laid in a driving area (approximately June 1) and ending October 31 or until the last nest has hatched.
b. Rut removal operations at sea turtle nest sites will commence per the following schedule or when the first hatchling emerges, whichever comes first:
• Loggerhead and green turtle nests - 45 days after the nest is laid.
• Leatherback turtle nests - 60 days after the nest is laid.
3. Level of Service
a. Rut raking shall be conducted in accordance with conditions 11.G.1.i.i and 11.G.1.ii.j of the ITP, United States Fish and Wildlife Service permit #TE811813-12 (Exhibit D) and the Volusia County Habitat Conservation Plan (HCP). The current Habitat Conservation Plan can be found here in its entirety:
https://www.volusia.org/core/fileparse.php/6127/urlt/Volusia_HCP_August_2022_c omplete-Accessible.pdf
b. Rut removal will commence after the beach is closed for public driving at 7:00 p.m.
In the event that additional time is needed to complete the list of nests needing raking, HCP staff should be consulted to identify areas of highest importance to rake first and rut raking start time can be adjusted. Starting time cannot be earlier than 5:30 p.m. to minimize the potential for new ruts being created after rut raking is completed. All Contractor vehicles shall be off the beach before sunset. Trash collection and rut raking can occur concurrently until sunset.
c. All non-routine changes to a rut raking routine must be cleared with the HCP on-call staff person at the time of the event. Examples include but are not limited to starting earlier than 7:00 p.m. or cancelling a raking shift due to inclement weather.
d. Contractor Personnel assigned to rut-raking must wait one hour for inclement weather to subside prior to calling the HCP on-call representative to request cancellation for the evening run.
4. General
a. Volusia County HCP staff will generate a nest list indicating the location of the nests and date the rut removal is to be conducted and will make this available to the Contractor daily via a Survey 123 application or other designated electronic tracking software.
b. The Contractor shall be responsible for completing the forms provided by HCP staff electronically in the field using a Survey 123 application or other designated electronic tracking software to show that ruts were inspected and rut removal was performed (or not, as needed). All rut raking reports are to be submitted to HCP staff nightly while conducting the raking activities via the app. Any missing or incorrect information on the HCP-provided list should be reported immediately upon discovery, and a comment should be entered into the app.
c. The Contractor is responsible for providing sufficient phones and/or tablets to all necessary Contractor personnel for operation of Survey 123 or other designated electronic tracking software.
d. All Contractor personnel shall be trained by Volusia County HCP staff on how to evaluate nest sites to determine if rut removal is needed and how to rake. Training shall take place annually prior to the first required rut raking operation. HCP staff and the County Project Manager reserve the right to have any employee who is not performing or not trained in rut raking re-assigned to a non-rut raking position.
e. Mechanical rut raking equipment shall be approved by Volusia County HCP staff prior to use.
