About this file

Summary

Exhibit G is a Clean Air and Water Certificate required for contract awards exceeding $100,000 between a Local Educational Agency (LEA) and a Food Service Management Company (FSMC) in Colorado. This certificate documents the FSMC's commitment to comply with federal environmental regulations, specifically the Clean Air Act and Federal Water Pollution Control Act, and must be executed by authorized representatives of both the LEA and the FSMC for all new and renewal contract years meeting the threshold. The certificate applies to all facilities used in contract performance and requires that no work be performed at facilities listed on the Environmental Protection Agency's List of Violating Facilities at the time of contract award unless EPA removes the facility from that listing.

The FSMC agrees to comply with all inspection, monitoring, reporting, and information requirements under Section 114 of the Clean Air Act and Section 308 of the Federal Water Pollution Control Act, and to use best efforts to maintain clean air and water standards at all performance locations. The FSMC must also insert the substance of these environmental provisions into any nonexempt subcontracts. Compliance encompasses adherence to all enforceable rules, regulations, standards, and limitations issued under these acts, as well as compliance with court orders, EPA orders, or Air and Water Pollution Control Agency directives related to environmental standards.
