About this file

This document is a Certification Regarding Lobbying form required for federal contracts, grants, cooperative agreements, and loans exceeding $100,000 in federal funds. The certification is mandated by Section 1352, Title 31, U.S. Code and serves as a material representation of fact that must be submitted prior to entering into any applicable transaction. The form requires the submitting official to certify that no federal appropriated funds have been or will be paid to influence officers or employees of federal agencies, Members of Congress, or congressional staff in connection with the awarding of federal contracts, grants, loans, cooperative agreements, or modifications thereof.

The certification imposes significant compliance obligations on recipients and their subrecipients. Any person failing to submit the required certification is subject to civil penalties ranging from $10,000 to $100,000 per violation. If non-federal funds have been or will be used for lobbying activities related to the federal transaction, the recipient must complete and submit Standard Form-LLL, the Disclosure Form to Report Lobbying, in accordance with its instructions. Recipients must also require that this certification language be included in all subaward documents exceeding $100,000 in federal funds at all tiers, with all subrecipients required to certify and disclose accordingly.
