About this file

This document is Exhibit C detailing Federal Disadvantaged Business Enterprise (DBE) requirements for WIIN Lead Testing, applicable to Indian Tribal, State, and Local Government recipients procuring construction, equipment, services, and supplies under federal funding. The exhibit outlines six specific good faith efforts recipients must implement to ensure DBE participation, including making contracting opportunities known to DBEs, arranging contract timeframes that facilitate DBE participation, considering subcontracting possibilities with DBEs, and encouraging consortium arrangements when individual DBE firms cannot handle large contracts.

The requirements mandate recipients to proactively support DBE involvement by placing DBEs on solicitation lists, posting bid solicitations for at least 30 calendar days, dividing large contracts into smaller tasks when economically feasible, and utilizing resources from the Small Business Administration (SBA) and Minority Business Development Agency. Prime contractors are also required to follow these same DBE engagement steps when awarding subcontracts. These guidelines are designed to maximize DBE participation in federally funded procurement processes across various government jurisdictions, with a focus on creating equitable contracting opportunities for disadvantaged businesses.

Exhibit C Federal DBE requirements WIIN Lead Testing

Requirements for Following 40 CFR Part 33 Sub-part C DBE Good Faith Efforts

Recipients are required to make the following good faith efforts whenever procuring construction, equipment, services, and supplies under federal funding.

1. Ensure DBEs are made aware of contracting opportunities to the fullest extent practicable through outreach and recruitment activities. For Indian Tribal, State, and Local

Government recipients, this will include placing DBEs on solicitation lists and soliciting them whenever they are potential sources.

2. Make information on forthcoming opportunities available to DBEs, arrange time frames for contracts, and establish delivery schedules, where the requirements permit, in a way that encourages and facilitates participation by DBEs in the competitive process. This includes, whenever possible, posting solicitations for bids or proposals for a minimum of 30 calendar days before the bid or proposal closing date.

3. Consider in the contracting process whether firms competing for large contracts could subcontract with DBEs. For Indian Tribal, State, and Local Government recipients, this will include dividing total requirements when economically feasible into smaller tasks or quantities to permit maximum participation by DBEs in the competitive process.

4. Encourage contracting with a consortium of DBEs when a contract is too large for one of these firms to handle individually.

5. Use the services and assistance of the SBA and the Minority Business Development Agency of the Department of Commerce.

6. If the prime contractor awards subcontracts, require the prime contractor to take the steps in items 1 through 5.
