FOR THE CONTRACTOR

Item 17. Specify appropriate price group from one of the following groups of effort in developing estimated prices for each data item listed on the DD Form 1423.

a. Group I. Definition - Data which is not otherwise essential to the contractor's performance of the primary contracted effort (production, development, testing, and administration) but which is required by DD Form 1423.

Estimated Price - Costs to be included under Group I are those applicable to preparing and assembling the data item in conformance with Government requirements, and the administration and other expenses related to reproducing and delivering such data items to the Government.

b. Group II. Definition - Data which is essential to the performance of the primary contracted effort but the contractor is required to perform additional work to conform to Government requirements with regard to depth of content, format, frequency of submittal, preparation, control, or quality of the data item.

Estimated Price - Costs to be included under Group II are those incurred over and above the cost of the essential data item without conforming to Government requirements, and the administrative and other expenses related to reproducing and delivering such data item to the Government.

c. Group III. Definition - Data which the contractor must develop for his internal use in performance of the primary contracted effort and does not require any substantial change to conform to Government requirements with regard to depth of content, format, frequency of submittal, preparation, control, and quality of the data item.

Estimated Price - Costs to be included under Group III are the administrative and other expenses related to reproducing and

d. Group IV. Definition - Data which is developed by the contractor as part of his normal operating procedures and his effort in supplying these data to the Government is minimal.

Estimated Price - Group IV items should normally be shown on the DD Form 1423 at no cost.

Item 18. For each data item, enter an amount equal to that portion of the total price which is estimated to be attributable to the production or development for the Government of that item of data.

These estimated data prices shall be developed only from those costs which will be incurred as a direct result of the requirement to supply the data, over and above those costs which would otherwise be incurred in performance of the contract if no data were required. The estimated data prices shall not include any amount for rights in data. The Government's right to use the data shall be governed by the pertinent provisions of the contract.

a. Deliverable is by Task Order. Deliverable shall correspond to the disclosed country, by base or option year in which the deliverable is funded using the Unit Price Book (UPB) line item corresponding to this Data Item listed in the CDRL and Block 1 of this form.

b. Delivery shall be in accordance with the program schedule by country.

c. The deliverable shall include, but not limited to, course charts, course content, course outline, wall charts, viewgraphs, plans of instruction as used by the contractor to teach the course.

d. Deliverable access, information and usability shall be identical to the information used by the contractor to teach the course regardless of venue (CONUS, OCONUS, classroom, hands-on training).

e. Downloadable (preferred) or Portable digital copy shall be provided on common media--CD-ROM or DVD in a universally executable format (MS Office, PDF, other, etc.). Wall charts or other items not easily reproducible or not conducive to digital copy shall be provided by hard copy. Inaccessible/unexecutable digital material will be considered non-delivered until accessible/executable material is delivered.

3. Minimum deliverable page markings shall adhere to DFARS 252.227-7020, RIGHTS IN SPECIAL WORKS (JUN 1995), as specified in paragraphs (c) and (d):

(c) License rights.

(1) The Government shall have unlimited rights in works first produced, created, or generated and required to be delivered under this contract.

(2) When a work is first produced, created, or generated under this contract, and such work is required to be delivered under this contract, the Contractor shall assign copyright in those works to the Government. The Contractor, unless directed to the contrary by the Contracting Officer, shall place the following notice on such works:

“© (Year date of delivery) United States Government, as represented by the Secretary of (department). All rights reserved.”

For phonorecords, the “©” marking shall be replaced by a “P”.

remarksb: (3) The Contractor grants to the Government a royalty-free, world-wide, nonexclusive, irrevocable license to reproduce, prepare derivative works from, distribute, perform, or display, and to have or authorize others to do so, the Contractor's copyrighted works not first produced, created, or generated under this contract that have been incorporated into the works deliverable under this contract.

(d) Third party copyrighted data. The Contractor shall not incorporate, without the written approval of the Contracting Officer, any copyrighted works in the works to be delivered under this contract unless the Contractor is the copyright owner or has obtained for the Government the license rights necessary to perfect a license of the scope identified in paragraph (c)(3) of this clause and, prior to delivery of such works—

(1) Has affixed to the transmittal document a statement of the license rights obtained; or

(2) For computer software, has provided a statement of the license rights obtained in a form acceptable to the Contracting Officer.

4. Courseware Naming Convention:

The contractor shall include a label on the courseware for catalog purposes, with [Two-Digit Company Initial(s)]-[Data Item Number]-[Two-Digit Country Code]. The country code will be provided by AFSAT.

Fictitious Example: “XY-A003-CA”. This would indicate contractor XY, deliverable for F-16 Integrated Avionics Systems - Attack Avionics, for Canada.

Inaccessible/unexecutable digital material will be considered non-delivered until accessible/executable material is delivered.

3. Minimum deliverable page markings shall adhere to DFARS 252.227-7020, RIGHTS IN SPECIAL WORKS (JUN 1995), as specified in paragraphs (c) and (d):

(c) License rights.

(1) The Government shall have unlimited rights in works first produced, created, or generated and required to be delivered under this contract.

(2) When a work is first produced, created, or generated under this contract, and such work is required to be delivered under this contract, the Contractor shall assign copyright in those works to the Government. The Contractor, unless directed to the contrary by the Contracting Officer, shall place the following notice on such works:

2. Blocks 10, 12, 14:

a. Deliverable is by Task Order. Deliverable shall correspond to the disclosed country, by base or option year in which the deliverable is funded using the Unit Price Book (UPB) line item corresponding to this Data Item listed in the CDRL and Block 1 of this form.

b. Delivery shall be in accordance with the program schedule by country.

c. The deliverable shall include, but not limited to, course charts, course content, course outline, wall charts, viewgraphs, plans of instruction as used by the contractor to teach the course.

d. Deliverable access, information and usability shall be identical to the information used by the contractor to teach the course regardless of venue (CONUS, OCONUS, classroom, hands-on training).

e. Downloadable (preferred) or Portable digital copy shall be provided on common media--CD-ROM or DVD in a universally executable format (MS Office, PDF, other, etc.). Wall charts or other items not easily reproducible or not conducive to digital copy shall be provided by hard copy. Inaccessible/unexecutable digital material will be considered non-delivered until accessible/executable material is delivered.

3. Minimum deliverable page markings shall adhere to DFARS 252.227-7020, RIGHTS IN SPECIAL WORKS (JUN 1995), as specified in paragraphs (c) and (d):

(c) License rights.

(1) The Government shall have unlimited rights in works first produced, created, or generated and required to be delivered under this contract.

(2) When a work is first produced, created, or generated under this contract, and such work is required to be delivered under this contract, the Contractor shall assign copyright in those works to the Government.
