About this file
This document is an Exhibit N detailing Key Performance Measures and Liquidated Damages for RFO No. HHS0017000, a Maven Registries Maintenance and Operations contract with the Texas Department of State Health Services (DSHS). The contract establishes eleven key performance measures with associated liquidated damages to ensure the contractor meets specified service levels and deliverable requirements. These measures include submission of transition project work plans within seven calendar days and thirty business days of contract effective date, timely submission of change management plans within five business days, delivery of high-level estimates in approved formats within DSHS-specified timeframes, correction of user acceptance testing (UAT) environment defects according to severity levels within one to thirty business days, preparation and submission of a turnover plan at least nine months before the final contract year, notification of application security exploits within one calendar day of discovery, completion of Maven registry help desk ticket analysis and triage within twelve hours, and correction of production defects according to mutually agreed deadlines following response times prescribed in applicable Metal service plans. All measurement periods are monthly unless otherwise specified.
Liquidated damages are assessed on a per-instance or per-business-day basis depending on the specific performance measure. Minor violations carry penalties ranging from $50 to $200 per business day with monthly caps of $2,000 to $4,000, while critical issues such as security exploits incur damages of $1,000 per calendar day or actual costs incurred by DSHS, whichever is greater. UAT defect corrections are penalized at $500 per clock hour for Severity 1 defects beyond one business day and $250 per business day for Severity 2 and 3 defects. Production defect resolution penalties vary from $100 to $500 per calendar day depending on severity level. The document specifies that portion thereof language applies, meaning that any partial percentage point deviation triggers liquidated damages based on the full percentage point rounded up.

Exhibit N, Key Performance Measures and
Liquidated Damages
Maven Registries Maintenance and Operations (M & O) Key Performance Measures and
Liquidated Damages
The Contractor must achieve the following Key Performance Measures (KPMs). For purposes of these KPMs, all measurement periods shall be monthly unless otherwise specified. Additionally, when a Liquidated Damage refers to a percentage point or portion thereof, the "portion thereof" means that a total percentage point deviation is not required to assess the Liquidated Damage. For example, if the standard is 99% and the results achieved are 98.6%, the Liquidated Damage that may be assessed is based on 1.0% point. If the results are 97.9%, the Liquidated Damage that may be assessed is based on 2.0% points.
