About this file
This is a Performance and Payment Bond Form template issued by the State of Texas, Board of Regents of The Texas State University System, for use on state contracts. The document serves as a standardized bonding instrument required for construction or service contracts with Texas State University System campuses. The form establishes the contractual obligations between a principal contractor, a surety company, and the State of Texas as obligee. The performance bond requires the contractor to faithfully perform all work in accordance with plans, specifications, and contract documents, while the payment bond ensures that all laborers, material suppliers, and claimants are promptly compensated for work performed under the contract. Both bonds are filed in Travis County, with venue for any legal action restricted to that jurisdiction.
The bond amounts are left blank in this template form, to be completed based on individual contract requirements. For bonds exceeding $100,000, the surety must provide evidence of either holding a certificate of authority from the United States Secretary of the Treasury or having obtained reinsurance from a Treasury-authorized reinsurer. The performance bond requires the surety to assume completion of the contract within fifteen days of the State of Texas declaring the principal in default. The surety's liability is limited to the penal sum of the bond and includes responsibility for all loss, expense, and attorney's fees incurred by the State. The bonds are issued pursuant to Section 2253.021, Texas Government Code, as amended, and the surety waives notice of any changes, extensions, alterations, or additions to contract terms or specifications.
