About this file
This is a Definitions document for RFP 2026-P03 Eastside Campus - Construction Manager at Risk (CMAR) issued by Hays County, Texas. The document provides comprehensive definitions of 60 key terms and concepts relevant to the construction management procurement process. The definitions cover organizational roles including the Contractor, County, Design Consultant, Project Manager, and Project Team; contractual elements such as Agreement, Proposal, Respondent, and Successful Respondent; construction-related terms including Building Code, Construction Phase, Commissioning, and Constructability; and financial components including Allowance, Guaranteed Maximum Price (GMP), and contract acceptance procedures. The document establishes that the Contractor will function as a Construction Manager at Risk, responsible for reviewing and participating in construction document production, soliciting competitive bids from trade subcontractors, and performing work as identified in the contract documents.
The definitions establish that the GMP represents the maximum price agreed upon by the County and CMAR for managing, supplying, and installing all work shown in complete Construction Documents, comprising direct construction costs, General and Supplementary Conditions, Performance and Payment Bonds, Contractor fee, overhead, and profit. The document defines critical processes including Plan Review by certified Plans Examiners, Construction Observation by design professionals, and Commissioning by specialized professionals to verify system performance against project requirements and industry standards. The Proposal submitted by Respondents is specified as irrevocable during the evaluation and acceptance period unless a waiver is obtained from the Hays County Purchasing Agent, and successful award requires acceptance by the Hays County Commissioners Court. The document also clarifies that an Ensuing Agreement may be required containing additional terms necessary to ensure compliance with the Solicitation and the Respondent's Proposal specifications.
