About this file
This is a References and Past Project Performance Form submitted by a respondent to the Texas Workforce Commission for the Child Care Expansion Initiative (CCEI) Program Administrator contract. The form requires respondents to provide a minimum of three references from entities for which similar services were performed within the past five years, preferably from state, federal, and local governmental entities. Respondents must document their contractual work history over the preceding five-year period, including project descriptions, outcomes, dates of service performance, contact information for reference organizations, original and final contract amounts, and the types of services provided as either prime contractor or subcontractor. The form also requires completion of a separate Form 4 Respondent Release of Liability for each reference listed.
The contractual work history section requires respondents to disclose any sanctions, liquidated damages, or other monetary remedies assessed under existing or past contracts; any threatened, pending, or resolved disciplinary actions for substandard work or unethical practices; any orders, judgments, or decrees from federal or state authorities limiting the respondent's right to engage in business; any civil or criminal litigation or compromise, settlement, or consent decree agreements related to contract performance; and any project terminations, work stoppages, or contract terminations for default or convenience within the past five years. Failure to disclose material information may result in contract termination and liability for all re-procurement costs and associated increases. The form emphasizes that respondents should provide complete details including the names, addresses, and telephone numbers of other contracted parties involved in any past incidents or disputes.
