About this file
This document is a Request for Proposal (RFP) issued by the Ute Mountain Ute Tribe (UMUT) for a fiber optic network construction project funded through the Economic Development Administration (EDA). The project involves constructing a middle-mile fiber network from a communications hut located on G.2 Road south of Cortez, Colorado, extending through the tribal entrance to the Public Works building in Towaoc. The total project scope covers approximately 42,487 linear feet of fiber installation, with a bid deadline of May 2, 2024, at 3:00 p.m. MT. A non-mandatory pre-bid conference is scheduled for April 9, 2024, at 11:00 AM MT via Zoom. The project is expected to be completed by November 14, 2025, with an anticipated total bid price of approximately $2.5 million.
The project is primarily funded through an EDA grant and will require compliance with federal regulations, including Davis-Bacon prevailing wage requirements, Equal Employment Opportunity standards, and Buy America provisions. Bidders must provide a 5% bid bond, submit evidence of E-Verify participation, and demonstrate the ability to work within the tribal jurisdiction. The solicitation encourages participation from small, minority, and women-owned businesses, with a preference for local and tribal employment. Contractors will need to provide comprehensive insurance coverage, including general liability, professional liability, workers' compensation, and performance and payment bonds. The project aims to expand broadband infrastructure for the approximately 2,000 residents of the Ute Mountain Ute Reservation.

11.02 All prices that Bidder sets forth in its Bid will be based on the presumption that the Contractor will furnish the materials and equipment specified or described in the Bidding Documents, as supplemented by Addenda. ARTICLE 12—SUBCONTRACTORS, SUPPLIERS, AND OTHERS
12.01 Bidder must submit to Owner a list of the Subcontractors or Suppliers proposed for any portions of the Work in its proposal.

Subcontractor or Supplier, Owner may, before the Notice of Award is given, request apparent Successful Bidder to submit an acceptable substitute, in which case apparent Successful Bidder will submit a substitute, Bidder’s Bid price will be increased (or decreased) by the difference in cost occasioned by such substitution, and Owner may consider such price adjustment in evaluating Bids and making the Contract award.
12.03 If apparent Successful Bidder declines to make any such substitution, Owner may award the Contract to the next lowest Bidder that proposes to use acceptable Subcontractors and Suppliers.
Declining to make requested substitutions will constitute grounds for forfeiture of the Bid security of any Bidder. Any Subcontractor or Supplier, so listed and against which Owner or Engineer makes no written objection prior to the giving of the Notice of Award will be deemed acceptable to Owner and Engineer subject to subsequent revocation of such acceptance as provided in Paragraph 7.07 of the General Conditions.
