Equal Benefits Ordinance (EBO) Disclosure and Certification

This document is an Equal Benefits Ordinance disclosure and certification form issued by the City of Long Beach that outlines nondiscrimination requirements for contractors and vendors entering into contracts with the municipality. The EBO applies to for-profit employers with City contracts valued at $100,000 or more for goods, services, public works, improvements, or construction projects, as well as for-profit entities generating $350,000 or more in annual gross receipts when leasing City property under written agreements exceeding 29 days in any calendar year. Selected contractors must comply with the ordinance during contract performance by providing equal benefits to employees with spouses and employees with domestic partners, including health benefits, bereavement leave, family medical leave, membership and membership discounts, moving expenses, retirement benefits, and travel benefits. Cash equivalent payments are permitted when employers have made reasonable efforts to provide domestic partner benefits but are unable to do so due to insurance provider limitations. Before contract execution, contractors subject to the EBO must complete the EBO Certification Form or obtain a waiver from the City and must allow authorized City representatives access to records for compliance verification.

The ordinance includes provisions allowing contractors to delay implementation of compliance procedures under specific circumstances: by the first effective date after the first open enrollment process following the contract start date (not to exceed two years) if reasonable measures are demonstrated; when administrative steps to incorporate nondiscrimination benefits can be implemented (not to exceed three months); or upon expiration of current collective bargaining agreements. Contractors who fail to comply after applicable delays may be deemed in material breach of contract, resulting in cancellation, termination, or suspension of the City agreement; disqualification from City contracting for three years; assessment of liquidated damages; and pursuit of other available legal remedies. The certification form requires contractor information, compliance status questions, documentation requirements at contract issuance, and a declaration under penalty of perjury that the contractor will comply with all EBO obligations outlined in the Long Beach Municipal Code and contract terms.
