Questions and Responses June 6, 2019

1. Question: If a company is awarded a master Basic Ordering Agreement (BOA), does it guarantee them a task order to provide vessel services, or just makes them eligible?

Government Response: If a responsible and qualified contractor is awarded a Regional Class Vessel and/or Global Class Vessel Basic Ordering Agreement (BOA) master contract (unfunded), and a period of performance of ten (10) years from date of award, they are eligible to receive a task order. For each task order under the contract, the Contracting Office shall send a Task Order Request for Quote (TORFQ) to the contractor(s). The request will contain a detailed description of the tasks to be achieved, a schedule for completion of the task order, and deliverables to be provided by the contractor. NOAA will select, for award of a BOA within a specific vessel class, all vendors which agree to the terms and conditions for a specific vessel class, who has a vessel(s) which meets or exceeds the specification listed for a specific vessel class, and who receives a past performance rating of satisfactory or better. If multiple BOA contract awards are made by the Government, the Contracting Officer shall provide each awardee a fair opportunity to be considered for each task order over the micro-purchase threshold unless an exemption applies. The evaluation award criteria used for each BOA Task Order competition is as follows:

The Government will award a task order resulting from this BOA Task Order Request for Quote (TORFQ) to the responsible contractor whose offer conforming to the Basic Ordering Agreement (BOA) terms and conditions will be most advantageous to the Government, price and other factors considered. Award will be based on the Lowest Price Technically Acceptable (LPTA) submission.

To be technically acceptable the offeror must submit a vessel that has been technically accepted on their awarded Basic Ordering Agreement (BOA) and meets all of the requirements included in the Statement of Work for Marine Services to Support Maintenance for the National Data Buoy Center’s (NDBC Ocean Observation System of Systems (NOOSS) Global Class Vessel, dated June 16, 2015. The Government intends to award a Lowest Price Technically Acceptable (LPTA), firm-fixed-price Task Order. The overall price will be evaluated to include all Other Direct Costs (ODCs) reimbursable items, which were provided by the Government.

BOA Task Orders will be competed among the BOA holders for a particular vessel class (Global or Regional). These orders are subject to a small business review that will allow for set-aside to small business or other socio-economic status vendors if it is determined to be in the Governments best interest.

Also, each resulting BOA Task Order is a Firm-Fixed-Price (FFP) order with a Contract Line Item (CLIN) for the number of Days-at-Sea (DAS) or Operational Day Rate. These orders will also have a cost-reimbursement line item for Other Direct Costs (ODC). This price element will be determined by the Government and the estimated cost will be provided to each competing offeror when the BOA Task Order Request for Quote (TORFQ) is issued to eligible BOA vendors. Also, in the ODC CLIN, each offeror will be required to insert their Material and Handling Fee (% of the ODC CLIN).

Below is an example of the CLIN structure and pricing from a recently awarded Global Class Vessel BOA Task Order:

CLIN 0001- (FIRM FIXED-PRICE DAY RATE)

The contractor shall furnish the necessary vessel(s), personnel, material, equipment, services and facilities (except as otherwise specified) to support the proposed buoy servicing operations in accordance with the Global Class Basic Ordering Agreement (BOA) for the National Data Buoy Center (NDBC) in accordance with the Basic Ordering Agreement (BOA) Statement of Work (SOW), NDBC Marine Vessel SOW – Global Class, dated June 16, 2015, and Task Order SOW, Marine Services FY 2018 Maintenance of the National Data Buoy Center's Atlantic and Ocean Pacific Buoys, dated May 3, 2017 (incorporated herewith and attached, Attachment 1). Please propose a day rate unit price for Contract Line Item (CLIN) 0001.
