U.S. MARSHALS SERVICE – JUSTICE PRISONER ALIEN AND

TRANSPORTATION SYSTEM

AIRCRAFT AVIONICS SUITE UPGRADE (N279AD)

RFQ # DJM-17-A37-Q-0192 – AMENDMENT 0001

Amendment 0001 - JPATS is providing their responses to questions that have been submitted by interested vendors:

QUESTION #1: Ref SOW, Section A, third paragraph - “The specific requirements of these alterations must be accomplished, utilizing “approved data” as supplied by the Contractor”. Please define the requirements of “approved data”, i.e. engineering approved, FAA DER approved where possible unless STC is required, STC Approved, etc. Basically what level of approval of the engineering data is required?

RESPONSE: “Approved” data is defined in Title 14 CFR Part 1.1 and detailed further in Advisory Circular (AC) 43-210A Dated 8/17/16 entitled “Standardized Procedures for Obtaining Approval of Data Used in the Performance of Major Repairs and Major Alterations.” JPATS requirement is that approved data be utilized in performance of the alterations detailed in this solicitation. JPATS is looking for each offeror to detail in their proposal the appropriate levels of approved data they intend to utilize.

QUESTION #2: Ref SOW, Section C, Fifth paragraph – “Contractor must adhere to applicable statutes and regulations as prescribed by the FAA.” This ties into the first question as to the level of approval required.

RESPONSE: This requirement is merely stating that JPATS, as a Public Aircraft operator, will not provide relief from statutory or regulatory mandates within the offerors Repair Station / Repair Station Quality Manuals. Also, see response to Question #1.

QUESTION #3: Ref SOW Section C, Ninth paragraph – “All parts will be accompanied with appropriately filled out FAA Form 8130 or an EASA Form 1.” This implies that we are providing STCs for any not previously STC’d modification that the parts are being supplied under PMA. Please confirm.

RESPONSE: No, it should not be construed in that fashion. The intent of this particular requirement is applicable to the specific Line Replaceable Units (LRU) or serially controlled rotables that are identified to be installed by the Contractor in association with the proposed alterations. These LRUs / rotables must have an appropriately filled out FAA Form 8130 or an EASA Form 1 thereby demonstrating a level of serviceability acceptable to the FAA.

QUESTION #4: Ref SOW, Section C, Eleventh paragraph – “The contractor will perform all documentation…as well as FAA Form 337 for major repairs.” This implies that all modifications will have some level of FAA approval. Please confirm.

RESPONSE: The second line of this sentence (requirement) has the verbiage “as applicable.” If the Contractor’s proposal stipulates an FAA Form 337 be generated in relation to any aspect of their proposal JPATS is placing responsibility on the Contractor to accomplish the form.

QUESTION #5: Ref SOW, Section D.1.a.i – is JPATS supplying Boeing Service Bulletin for installation of the Autopilot Mode Control Panel or is this part already approved for installation on this aircraft via the IPC?

RESPONSE: This part is already approved for installation on this specific aircraft in that it is identified in the IPC as an approved part.

QUESTION #6: Ref SOW, Section D.1.a.ii – Will JPATS request Boeing revise Service Bulletins 737-24-1220 and 737-24-1221 to add A/C N279AD (Variable No. PM261) as they are currently only effective for two other US Marshals Service A/C (Variable Nos. PM557 and PM 560)? As such, will JPATS supply those two updated and revised Service Bulletins in support of this modification?

RESPONSE: JPATS will make the referenced Service Bulletins available to the Contractor who, acting as an agent for JPATS, can petition Boeing to revise them for Aircraft Tail #

N279AD.

QUESTION #7: Ref SOW, Section D.1.b – Requirement will be dependent on the answers to section A.

RESPONSE: Reference Response to Question #1 (Ref Section A).

QUESTION #8: Ref SOW, Section D.1.c – is JPATS supplying a Boeing Service Bulletin and software applicable to this aircraft for the modification?

RESPONSE: No. JPATS is requiring the Contractor, acting as an agent for JPATS, source the required software and the associated Service Bulletin for the installation and operational checks of the software on N279AD and also N639CS and N640CS (Refer to D.5.b.)

QUESTION #9: Ref SOW Section D.2 – is JPATS obtaining the STC Rights to Use and installation kits from the STC holder for this modification or will the contractor need to obtain?

RESPONSE: JPATS will not pre-purchase any kit data or equipment for this. JPATS will support the vendor in gaining any authorizations that are required to complete the installation. If the vendor chooses to request Rights to Use technical data and install the approved kits from the STC holder instead of contracting directly from the STC holder, JPATS will secure the RTU authorization in coordination with all parties involved. All RTU data must be valid for JPATS transfer to any future owner of the aircraft.

QUESTION #10: Ref SOW, Section D.3 – Requirement will be dependent on answers questions on level of approval in Section A and C.

RESPONSE: Reference responses to Questions #1, #2, #3, & #4 (Ref: Sections A. and C.)

QUESTION #12: Ref SOW, Section D.5. - is JPATS supplying a Boeing Service Bulletin and software applicable to this aircraft for the modification?

RESPONSE: No, JPATS is requiring the Contractor, acting as an agent for JPATS, source the required software and the associated Service Bulletin for the installation and operational checks of the software on N279AD and also N639CS and N640CS (Refer to D.5.b.)

QUESTION #13: Ref SOW, Section D.6 - is JPATS supplying a Boeing Service Bulletin applicable to this aircraft for the modification?

RESPONSE: No, JPATS is requiring the Contractor, acting as an agent for JPATS, source the required approved data, which may or may not be a Service Bulletin, to perform this alteration.

QUESTION #14: Ref SOW, Section D.7 – Does JPATS have any existing “approved data” for this modification. If not requirement will be dependent on answers questions on level of approval in Section A and C.

RESPONSE: No, JPATS is requiring the Contractor, acting as an agent for JPATS, source the required approved data for the installation of the JPATS provided TCAS Control Panel.

QUESTION #15: Ref SOW, Section D.8– Does JPATS have any existing “approved data” for this modification. If not requirement will be dependent on answers questions on level of approval in Section A and C.

RESPONSE: No, JPATS is requiring the Contractor, acting as an agent for JPATS, source the required approved data for the installation of the JPATS provided TCAS Computer.

QUESTION #16: Ref SOW, Section D.9 – Does JPATS have any existing “approved data” for this modification. If not requirement will be dependent on answers questions on level of approval in Section A and C.

RESPONSE: No, JPATS is requiring the Contractor, acting as an agent for JPATS, source the required approved data for the alteration of the existing dual VHF radios to a triple radio configuration.

QUESTION #17: Regarding the E&E bay modification, has JPATS made a decision on the desired certification method for the mod? This is important as if an STC is required and one is not already available, this would have a substantial impact on both schedule and cost.

This was a key discussion during the industry day that was not resolved at that time.

RESPONSE: JPATS has established a requirement in this solicitation that all data utilized in association with these avionics upgrades be “approved.” “Approved” data is defined in Title 14 CFR Part 1.1 and detailed further in Advisory Circular (AC) 43-210A Dated 8/17/16 entitled “Standardized Procedures for Obtaining Approval of Data Used in the Performance of Major Repairs and Major Alterations.” JPATS is looking for each offeror to detail in their proposal the appropriate levels of approved data they intend to utilize.

QUESTION #18: Will JPATS be providing the software for the required software updates?

RESPONSE: No, JPATS is requiring the Contractor, acting as an agent for JPATS, source the required software and the associated Service Bulletin for the installation and operational checks of the software on N279AD and also N639CS and N640CS (Refer to D.5.b.)

QUESTION #19: In regards to the expansion of the E&E rack into the forward cargo, does the government currently have an STC for that rack expansion? Structural Installation, Electrical Installation, Burn Certification, and Smoke Penetration?

RESPONSE: No, JPATS does not have an STC for the E&E rack expansion. See Response to Question #17.
