The bid bond guarantees that the contractor will not withdraw their bid within thirty (30) days following bid opening and will enter into a formal contract if their bid is accepted. The contractor must submit properly executed Performance and Labor and Material Payment Bonds within ten (10) days of receiving notice of bid acceptance. A mandatory pre-bid conference is scheduled for October 8, 2026 at 10:00 a.m. at DMV, 850 Widgeon Road, Norfolk, Virginia 23513, with attendance required for all bidders. The bid bond amount is established at five percent (5%) of the total base bid plus all additive bid items. If the contractor withdraws their bid within the thirty-day period or fails to execute the required contract and bonds within ten (10) days of acceptance notice, the principal and surety are jointly and severally liable to the Commonwealth for the difference between the bid amount and any higher cost incurred by the Commonwealth to complete the work, up to the full bid guarantee amount. The surety must be legally authorized to conduct business in the Commonwealth of Virginia and must provide an affidavit and acknowledgement executed by an attorney-in-fact with notarization certifying authorization and validity of the Power of Attorney.
