About this file
This is an Instructions to Bidders document for the West Virginia Department of Environmental Protection (DEP) for construction and reclamation contracts. The document establishes the bidding procedures and mandatory requirements that vendors must follow when submitting bids for DEP procurement opportunities. All bids must be submitted electronically through the wvOASIS Vendor Self Service Portal before the stated bid closing date and time. Vendors are required to review all solicitation documents thoroughly, comply with mandatory terms identified by words such as "shall," "must," or "will," and acknowledge receipt of any addenda issued by the Department. A solicitation bond equal to five percent (5%) of the total bid amount is required. Bids submitted prior to the closing date will be made available to the public within 24 hours on the Department's website. The Department reserves the right to reject any bid deemed non-responsible or to accept or reject bids in whole or in part in accordance with its Standard Specification for Construction and Reclamation.
Contractors must hold a valid license issued by the West Virginia Contractor Licensing Board and include their license number on all bids; failure to do so results in automatic disqualification. For construction contracts valued at $100,000 or more, contractors must implement and maintain a written drug-free workplace policy compliant with West Virginia Code 21-1D and submit a signed, notarized drug-free workplace affidavit with their bid. Additionally, contractors must provide a certified drug-free workplace report no less than annually or upon project completion, detailing employee education and training, the certified laboratory performing drug tests, average employee numbers, and drug test results categorized by pre-employment, reasonable suspicion, post-accident, and random testing. All questions regarding solicitations should be directed to DEPProcurement@wv.gov with the solicitation number included in the subject line; no bids will be accepted by email. File submissions that are encrypted, password-protected, or incompatible will be deemed blank or incomplete and rejected.
