Answer: See the response for Question 116. See the responses for Questions 115 and 117.

96. Some areas of deck may have received over 4.5” of overlay which will stay in place. If the existing overlay material is

Silica-Fume please confirm that the new LMC overlay is compatible with the existing material and there will not be a bonding issue.

Answer: See Response to Comment No. 94. The 4.5” thickness is the average thickness of the existing overlay. See the response to Question 95. 4.5” thickness is the average thickness of the existing overlay.

110. The permit for this project also restricts activities within the Potomac River from April 15th through October 15th to mitigate disturbance of submerged aquatic vegetation (SAV), (page 4 paragraph 12 of the permit). Again, temperature restrictions on the epoxy grout that will be used to inject the cracks underwater make conducting injecting operations during this time frame critical to completing the project. Do you anticipate a restriction waiver being approved for work conducted by divers for this project:

Answer: See response Question 111. Epoxy grouting is allowed under the Letter Department of the Army Project -

NAB-2021-0015 Response: A waiver of time-of-the year restriction and associated restrictions and qualifications have been issued by DOEE and will be included in an amendment. Epoxy grouting is allowed under the Letter

District of Columbia Department of Transportation Attn: Mr. Huntae Kim 55 M Street SE Washington, DC 20003

RE: Department of the Army Project - NAB-2021-00158 Water Quality Certification - DC-2022-92

Dear Mr. Kim:

The Department of Energy and Environment (the Department) Fisheries and Wildlife Division has considered the DDOT request for a time-of-year waiver for the above-referenced permit, which includes work to rehabilitate the I-395 HOV Bridge (also known as the Rochambeau Memorial Bridge) over the Potomac River.

In the District, the anadromous fish migration and spawning season is generally considered to occur between March 1st and June 30th. Any activities proposed to occur in District waters during this period shall first be approved by the U.S. Army Corps of Engineers, accompanied by concurrence from commenting federal agencies. DOEE Fisheries and Wildlife Division (FWD) has reviewed these approvals in accordance with 21 DCMR § 1405 to ensure compliance with 21 DCMR §§ 1101 and 1104.

Based on a review of the information provided to the Department by the United States Army Corps of Engineers, including the May 22, 2023 authorization letter and June 16, 2023 modification to include time-of-year restriction waivers, DDOT may conduct in-river work in accordance with the above-referenced permit provided that:

a. A change in conditions does not require that the project area be closed during the identified period;

b. Pursuant to 21 DCMR § 1405, DDOT employs measures to protect migrating and spawning fish;

including limiting in-river work during the specified dates and restricting activities that generate significant underwater noise (e.g., pile driving, concrete drilling) within 200 linear feet of the Federal Navigation Channel during the designated spawning period (February 15 to June 15);

c. DDOT complies with the conditions of its water quality certification permit;

d. All conditions prescribed in this waiver are followed; and

e. All work is performed between sunrise and sunset times as determined by the United States Naval

Observatory.

Please contact me at (202) 997-9607 or rese.cloyd@dc.gov with any questions.

Sincerely, Rese Cloyd Associate Director, Fisheries and Wildlife Division Department of Energy and Environment
