About this file
This is a Foreign Countries of Concern Prohibited Affidavit required by Florida Statutes Section 287.138 for the Hillsborough County Public Schools (HCPS) Electrical Services solicitation. The affidavit must be completed and executed by an authorized representative of any proposer or contractor submitting a bid, proposal, or quote to HCPS, and submission of this completed form is mandatory for bid acceptance. The electrical services contract encompasses commercial high voltage electrical work including new installations, maintenance, repairs, electrical upgrades, modernizations, circuit breaker installations, panel upgrades, troubleshooting, and diagnostics. Contractors must demonstrate experience and capability to service a school district of HCPS's size, including expertise in high voltage systems, switchgear, and coordination with TECO. The contractor shall provide all necessary labor, materials, supervision, equipment, and related items required to fulfill service requests according to specified requirements.
The affidavit prohibits HCPS from contracting with any entity that is owned by, has a controlling interest held by, or is organized under the laws of a foreign country of concern, defined as the People's Republic of China, the Russian Federation, the Islamic Republic of Iran, the Democratic People's Republic of Korea, the Republic of Cuba, the Venezuelan regime of Nicolas Maduro, or the Syrian Arab Republic. The "controlling interest" threshold is set at 25 percent or more of voting interests or entitlement to 25 percent or more of profits. By executing the affidavit under penalties of perjury, the proposer's authorized representative attests that the legal company name does not meet any of the prohibited criteria. This requirement applies specifically to contracts that would provide access to individuals' personal identifying information.
