About this file

This document is the Tennessee Board of Regents 403(b) Retirement Plan Document, effective January 1, 2009 and revised November 1, 2016, governing the retirement plan for employees of the Tennessee Board of Regents and its affiliated institutions. The Plan provides eligible employees of the Tennessee Board of Regents system, including Tennessee Colleges of Applied Technology, state universities (Austin Peay State University, East Tennessee State University, Middle Tennessee State University, Tennessee State University, Tennessee Tech University, University of Memphis), community colleges, and the System Office, with the ability to participate in a 403(b) retirement arrangement through elective salary deferrals on a pre-tax basis. All employees of participating institutions become eligible to participate immediately upon employment. Employees may elect to reduce their compensation to make elective deferral contributions, with a minimum deferral amount established by the Administrator not to exceed $200. The Plan permits participants to change investment directions and beneficiary designations, with contributions transferred to approved funding vehicles within 15 business days following the end of the month in which the amount would otherwise have been paid. Participants may designate contributions among approved vendors offering annuity contracts or custodial accounts.

The Plan establishes contribution limitations aligned with Internal Revenue Code section 402(g), with the basic annual limitation being the lesser of the applicable dollar amount or the participant's includible compensation for the calendar year. Employees age 50 or older are permitted to make age 50 catch-up contributions up to $5,000 annually, adjusted for cost-of-living. The Plan does not permit loans or hardship withdrawals. Distributions may occur upon severance from employment, death, disability, or attainment of age 59½, with distributions to be made in accordance with individual agreements and IRC section 401(a)(9) minimum distribution requirements. The Plan accepts eligible rollover contributions from other retirement plans in cash form and permits plan-to-plan transfers for classes of employees. Participants may exchange investments among approved vendors and, if also participating in a tax-qualified defined benefit governmental plan, may transfer account balances for permissive service credit purchases. The Plan Administrator is the Tennessee Board of Regents, with April Preston, Assistant Vice Chancellor for Human Resources, designated as the primary contact for plan correspondence.

Except to the extent provided under section 414(u) of the Code, this right applies for five years following the ii14012 Highlight ii14012 Highlight resumption of employment (or, if sooner, for a period equal to three times the period of the interruption or leave).

3.8 Heroes Earnings Assistance and Relief Tax Act (The HEART Act).

(A) Death benefits. If a participant dies while performing qualified military service (as defined in Code §414(u)), the Participant's Beneficiary is entitled to any additional benefits (other than benefit accruals relating to the period of qualified military service) provided under the Plan as if the Participant had resumed employment and then terminated employment on account of death. Moreover, the Plan will credit the

Participant's qualified military service as service for vesting purposes, as though the

Participant had resumed employment under USERRA immediately prior to the

Participant's death.

(B) Benefit accrual. The Plan treats an individual who dies or becomes disabled (as defined under the terms of the Plan) while performing qualified military service with respect to the Employer as if the individual had resumed employment in accordance with the individual's reemployment rights under USERRA, on the day preceding death or disability (as the case may be) and terminated employment on the actual date of death or disability.

(C) Differential wage payments. Differential wage payments (as described herein) will be considered compensation for all Plan purposes. (i) An individual receiving a differential wage payment, as defined by Code §3401(h)(2), is treated as an employee of the employer making the payment; (ii) the differential wage payment is treated as compensation for purposes of Code §415(c)(3) and Treasury Reg. §1.415(c)-2; (iii) the

Plan is not treated as failing to meet the requirements of any provision described in

Code §414(u)(l)(C) by reason of any contribution or benefit which is based on the differential wage payment. This section applies only if all employees of the Employer performing service in the uniformed services described in Code §3401(h)(2)(A) are entitled to receive differential wage payments (as defined in Code §3401(h)(2)) on reasonably equivalent terms and, if eligible to participate in a retirement plan maintained by the Employer, to make contributions based on the payments on reasonably equivalent terms (taking into account Code §§410(b)(3), (4), and (5)).

(D) Deemed severance. Notwithstanding Section 3.8(C)(i), if a Participant performs service in the uniformed services (as defined in Code §414(u)(12)(B)) on active duty for a period of more than 30 days, the Participant will be deemed to have severance from employment solely for purposes of eligibility for distribution of amounts not subject to

Code §412. However, the Plan will not distribute such a Participant's account on account of this deemed severance unless the Participant specifically elects to receive a benefit distribution hereunder. If a Participant elects to receive a distribution on account of this deemed severance, then the individual may not make an elective deferral or employee contribution during the 6-month period beginning on the date of the distribution. If a Participant would be entitled to a distribution on account of a deemed severance, and a distribution on account of another Plan provision (such as qualified reservist distribution), then the other Plan provision will control and the 6-month suspension will not apply.

Participant's or Beneficiary's interest in the transferor plan (e.g., a pro-rata portion of the

Participant's or Beneficiary's interest in any after-tax employee contributions).
