PL315 – Task Assignment 204 – Monitoring of Conservation Easements and Land Protection Agreements
The Contractor will conduct site assessments to monitor Board of Trustees less-than-fee interests in the form of conservation easements or land protection agreements on private lands throughout the State. These conservation easements were acquired by the State to perpetuate existing land uses and conservation values on private lands while simultaneously allowing the landowner and his/her heirs and successors to continue to use the land.
Each conservation easement or land protection agreement enumerates certain rights retained by the landowner as grantor, prohibitions against certain activities, and rights granted to the State as grantee. The conditions of the property at the time the easement or agreement is executed are typically documented in a Baseline Documentation Report. The Division is responsible for ensuring that the grantor complies with all terms and prohibitions of the easement or agreement.
For new easements, DEP will provide the Contractor with Baseline Documentation Reports (BDRs), photopoint shapefiles, and boundary shapefiles by August 1 to allow adequate time for confirming boundaries prior to fall monitoring. For existing easements, DEP will provide the Contractor with updated easement boundaries prior to each monitoring cycle (Aug 1 for Fall cycle and Jan 15 for Spring). The Contractor will report significant discrepancies with boundaries from other sources, parcel data, and/or aerial photography to Bureau of State-Owned Lands Inventory (BSOLI). If discrepancies cannot be resolved before scheduled monitoring, Contractor will proceed using the DEP provided boundaries.
The Contractor shall monitor grantor compliance with the terms and conditions of conservation easements and land protection agreements held by the Board and provide updated resource descriptions and photo-documentation of sites where and when appropriate. The services will include, but will not necessarily be limited to, the following:
• Examining agricultural and silvicultural practices for compliance with easement restrictions and best management practices
• Assessing extent and quality of wetlands
• Reporting on presence and abundance of invasive and nonnative plants
• Determining the extent of new development and its compliance with easement restrictions
• Revisiting GPS photopoints and documenting any change with new photographs and descriptions of activities.
• Producing de facto baseline documentation for those easements and agreements for which it was not originally done
• Preparing monitoring reports using the template form (Exhibit A) developed by the Department.
Deliverables: Easements to be evaluated during fiscal year 2023-24 are listed in table 1. Contractor shall submit a monitoring report for each easement evaluated during the fall (2023) by January 4, 2024. Monitoring reports for easements evaluated during the spring (2024) shall be delivered by June 14, 2024.
Invoice Schedule: Costs for completed monitoring reports are listed in Table 1.
Invoice for the Fall 2023 Conservation Easement Monitoring is due no later than January 15, 2024.
Invoice for the Spring 2024 Conservation Easement Monitoring is due no later than June 17, 2024.
Invoices should be sent to the DEP CONTRACT MANAGER, Deborah Burr (Deborah.Burr@FloridaDEP.gov) and to Amy Horton (amy.horton@floridadep.gov).
All invoices shall include the corresponding reporting period. (For Example: Reporting Period: July 1, 2023 – December 30, 2023).
Work done under this Task is subject to the negotiated overhead rate of 10% as specified in the master agreement
PL315.
