About this file

This document is a "Questions to the Government" file for a U.S. Customs and Border Protection (CBP) Maritime Patrol Aircraft Maintenance and Logistical Services Request for Proposal. The document contains multiple pages of vendor questions regarding various aspects of the solicitation, including technical, management, and administrative requirements. Key areas of inquiry include clarifications on key personnel requirements, transition period details, calibration services, logbook completion, network access, parts sourcing, and contract type specifications. The questions seek to understand specific contract expectations such as the rotable pool of flight controls, OEM parts sourcing, stored aircraft responsibilities, and precise interpretation of performance work statement (PWS) language across multiple sections of the solicitation.

Noteworthy technical details include questions about P-3 and DHC-8 aircraft maintenance, with vendors seeking clarity on engine and propeller sourcing, calibration responsibilities, and inventory management. The document reveals the contract will be a hybrid type with Firm Fixed Price (FFP), Cost Plus Incentive Fee (CPIF), and Cost Reimbursement line items. Vendors are particularly interested in understanding transition period requirements, key personnel placement timing, and specific operational expectations for aircraft maintenance and logistical services. The government provides concise responses to most questions, often referring to specific sections that will be revised or clarifying existing contract language.

Questions to the Government

RFP/PWS Section Page RFP/SOW Language Question/Comment CBP Answer

PWS, Para C.1.2.7 Page 14 PWS States: "The Contractor shall develop the QCP (A003) and deliver to the COR for review and acceptance. The QCP shall be reviewed and updated annually at a minimum. The COR will review and approve all proposed changes and revisions to the QCP before implementation."

CDRL A003, Quality Control Plan, requires a draft of the plan be submitted with the proposal. Will the Government please confirm they require submission of a draft Quality Control Plan with the proposal? If required, will the Government please provide where in the proposal submission this document will be included (i.e., within the narrative, as an attachment/appendix)?

See A0002, revised L.13 General Instructions

PWS, Calibration Program Page 44 PWS states: " The Contractor shall perform calibration function in accordance with the standards of US Bureau Weights and Measures.

The Contractor shall maintain the PMEL certification documentation at the site/unit using the calibrated equipment. "

Will the Government please confirm that the Contractor is responsible for providing calibration services for test, measurement, and diagnostic equipment used on this program and that a Government-owned laboratory is not available for use?

See A0002 PWS revision

Will the Government provide a list of current incumbent vendors other than those in Appendix 1.7.6 and 1.7.7 to minimize disruptions for unique acquired or site preferred materials?

CBP does not maintain a list of vendors utilized by the incumbent contractor

Will the Government provide annual estimated material buys for GFM for proper estimating of contractor procurement personnel?

This is the first combined P-3 / DHC-8 maintenance contract. There is not a number of buys for CBP to provide.

The solicitation does include a cost estimate to be utilized by all vendors

L.3 52.204-16 page 69 The Offeror shall provide its CAGE code with its offer with its name and location address or otherwise include it prominently in its proposal.

The CAGE code must be for that name and location address. Insert the word "CAGE" before the number. The CAGE code is required prior to award.

Is it acceptable to include the CAGE code and address in the cover letter? If not, where in the proposal would the Government like for Offerors to include their CAGE code and address?

Use Block 15A

Attachments J.19, J.20, J.21, J.22, J.24 (Multiple Titles)

References throughout regarding the use of the Electronic Questionnaires for Investigations Processing (e-QIP) web based security information system.

It is our understanding that DHS CBP has transitioned from e- QIP to the National Background Investigation Services (NBIS) eApp system for processing initiating new security investigations. Is this accurate and will updated policies or guidance be provided accordingly to reflect this change?

There is no guidance that needs to be provided for the proposal phase

PWS, Section C.1.2.9 15 The Contractor shall furnish its own hand tools, shop upkeep supplies, office supplies, company IT network equipment, such as desktop computers, laptops, tablets, and printers for use on the Contractor’s own information management system, necessary for contract performance at no direct cost to the Government.

Will the Government provide network capabilities or internet access for contractor use in Government facilities?

The Contractor will be provided IT equipment and allowed access to CBP networks for internet connectivity in Government facilities. Only CBP computers will be allowed on the CBP network.

PWS, Section C.1.2.11 20 The Contractor shall use Original Equipment Manufacturer (OEM) approved sources to purchase the necessary parts, and material for the P-3s.

Will the Government provide a current listing of all OEM approved P-3 sources or provide access to Aerospace Maintenance and Regeneration Group for P-3 aircraft parts?

The Government does not maintain a list of OEM approved P-3 sources for P- 3 parts or repair.

Vendors may check the OEM website for OEM approved sources for P-3s.

Access to the Aerospace Maintenance and Regeneration Group is limited, the contractor would have to exhaust all commerical options before the Government will consider unpreserving a current P-3 for removal of part.

PWS, Section C.1.2.20, & Collective Bargaining Agreement AOS Conroe, TX, Article 01.01

PWS 27, CBA

In addition, A collective Bargaining Agreement (CBA) represents AOS Conroe, TX Labor.

The CBA provided by the Government for Conroe, TX is only applicable for Contract Number 70B02C2000000414. Is there a current CBA for the current Maritime Patrol Aircraft Maintenance contract at Conroe, TX, or is the intent that this current CBA will be used as a baseline to create a specific new CBA for the new contract?

Review 01.01 of the CBA, as well as

FAR 22.1002-3.

Currently, the PWS requires all Key Personnel to be in place at transition start, however, the CBP defined Key Personnel listing also includes Operational Site and Material Management/Inventory Control Point personnel.

Request the Government validate that all CBP defined Key Personnel must all be in place for the entire 90 days of transition or are the Program Office personnel and contractor selected Key Personnel all that are needed for transition, with the rest of the Key Personnel to be in place by the first day of full performance?

PWS Section C.1.2.29 updated to state

- The followig Program Office Key Personnel shall be in place at award:

PWS Section C.1.2.21 & C.1.2.30

28 & 38 C.1.2.21 CBP defines Contractor Key Personnel per functional area as follows:

Program Office

• Program Manager

• Deputy Program Manager

• Program Quality Assurance Manager

• Configuration Manager

• P-3 Structural Engineer

• DHC-8 Structural Engineer Operational Site

• Site Managers

C.1.2.29 Key Personnel shall be in place at the start of the transition period

PWS C.1.2.21 specifies the positions considered Key Personnel. PWS C.1.2.29 states the personnel slated to fill Key Personnel positions shall be in place at transition start.

This requirement appears to preclude offerors from hiring qualified incumbent employees into these positions, losing scarce security/program cleared expertise on these unique aircraft and benefitting the position of the Incumbent contractor-reducing competition.

In order to maintain the most qualified workforce possible for all offerors, will the Government consider revising the requirement to have all key positions in place at transition start to...having them identified at transition start and in place NLT contract PoP start?

Please see the revised PWS section C.1.2.29.

PWS Section C.1.3.2 42 Additionally, the Contractor shall provide aircraft servicing and handling of other government and foreign government transient aircraft as approved by the CBP COR.

Request the Government provide details on monthly or yearly transient aircraft that must be supported by location.

The Government cannot provide details on monthly or yearly transient aircraft that must be supported by location. The Government will state, however, execution of this PWS requirement is neither frequent nor habitual.

PWS Section C.1.4.14 61 The Contractor shall produce and maintain a rotable pool of flight controls.

Is the rotable pool of flight controls Contractor provided property? If yes, please provide the quantities and part numbers the Government is requesting?

No the rotable pool of flight controls are not Contractor provided property.

PWS Appendices 37 Engines T-56A-14, 32 installed/XX spares Props 54H60-77, 32 Installed/XX spares

Does the Government have any spare engines and props for the P-3 aircraft, if so what is the quantity? If not are contractors required to lease engines and propellers? If not, what is the sourcing plan for those engines and propellers?

Per the PWS it is a requirement of the contractors to have a sourcing plan for engines and propellers. The number of spare engines and props is not available at this time.

PWS Appendices 47 Engines/Props PW123, 16 installed/3 grated spares 14 installed on stored aircraft

72 blades installed 2 blades in stock

The appendices show 9 DHC-8 aircraft in Conroe, TX, but the engines/props data only shows 16 engines installed or that only 8 aircraft have engines installed. Request the Government reconcile this data or is there one DHC-8 that is currently out of service at Conroe, TX without engines?

Are the 14 engines installed on stored aircraft serviceable and are they available for use on this contract?

See A0002, PWS Appendix revision.

Reference to stored aircraft parts removed from Appendix 1.7.7 in A0003

PWS Appendices 47 Engines/Props PW123, 16 installed/3 grated spares 14 installed on stored aircraft

72 blades installed 2 blades in stock

The appendices show 7 stored DHC-8 aircraft, there is nothing in the PWS about an Offeror's responsibility for the stored aircraft. Request the Government provide requirements/responsibility an Offeror has for the stored DHC-8 aircraft and for how long if required?

The PWS has no requirement for stored aircraft.

Solicitation Section L.13 General Instructions & Factor 1, Technical, Subfactor 1, Material Management item 5.

70, 75 For this solicitation, Engines and Propulsion are critical functions.

The Offeror's proposal for a sound and realistic approach for Engine and Propulsion overhaul and repair to meet the operational performance of the PWS.

Request the Government clarify for these two areas is "Propulsion" intended to be Propeller? If not request the government clarify what is meant by Propulsion as Engines are already a critical function?

"Engines and Propulsion" includes engines, props, and associated linkages and components, the whole system. The Government does not want only propeller overhaul and repair.

PWS C.1.3.14 48 The Contractor shall properly complete the applicable logbooks and service record cards all aircraft under this contract in accordance with COMNAVAIRINST 4790.2. Legacy DHC-8 records will need to be transcribed into this format.

What is the required completion date of this action for DHC-8 aircraft or is it being completed before the award of this contract?

See PWS C.1.3.14 revision

Solicitation Section L.13 General Instructions, Factor 2:

Solicitation Section L.13 General Instructions, Factor 2:

Management, Subfactor 1:

Personnel Management & Appendix 1.7.5, CDRL A018

75, 27 A completed Attachment J-2 (Personnel Management Plan). Each offeror shall identify labor categories, job code descriptions, the number of Full Time Equivalents (FTE)s, hours, work type full time (FT) or part time (PT), shift, and WBS/CLIN for both onsite and offsite management (excluding temporary personnel assisting with the transition phase) to meet the requirements of this solicitation.

A018 Work Breakdown Sturcture, due One time + as required, PoP Start + 90 Days

Within Attachment J.02 the instructions state to complete the WBS/CLIN column, since CDRL A018 (WBS) is not due until 90 days after PoP Start, can Offerors provide the planned supported CLIN instead of the WBS/CLIN in Attachment J.02?

WBS removed from J-2

Solicitation Section L.13 General Instructions

69 Each of the parts shall be separate and complete so that evaluation of one may be accomplished independently from evaluation by the other.

After evaluation of Step 1, if changes are required to an Offerors Attachment J.02 is that allowed or required? Or is the pricing independent of the proposed manning used in Step 1 since each evaluation is noted by the Government as independent?

No. In Phase 2, offerors are required to price their Phase 1 proposal

L.8 52.222-46 Evaluation of Compensation for Professional Employees

69 It is unclear, based upon the requirements of the Solicitation PWS, the need for offerors to provide a total compensation plan setting forth proposed salaries and fringe benefits for professional employees in accordance with FAR Clause 52.222-46. Professional employee , as used in FAR SubPart 22 , means any person meeting the definition of "employee employed in a bona fide professional capacity" given in 29 CFR541. The term embraces members of those professions having a recognized status based upon acquiring professional knowledge through prolonged study. Examples of these professions include accountancy, actuarial computation, architecture, dentistry, engineering, law, medicine, nursing, pharmacy, the sciences (such as biology, chemistry, and physics, and teaching). To be a professional employee, a person must not only be a professional but must be involved essentially in discharging professional duties. The employees for this effort will primarily be covered by the Service Contract Act (including CBAs) or Exempt management personnel, so this FAR Clause is unnecessary.

52.222-46 removed from the solicitation

J-1A Offeror and Sub Summary J-1A Offeror and Sub Summary asks for the entity CAGE Code/DUNs; however, DUNs have been replaced with Unique Entity Identifiers (UEI). Does the Government want the DUNs or the UEI?

DUNS replaced with UEI in J-1A

I.37 52.216-8 FIXED FEE (JUN

2011)

Page 28 Section B.2 CONTRACT TYPE (OCT 2008), Page 12, specifies that “This is a Hybrid contract with Firm Fixed Price (FFP), Cost Plus Incentive Fee (CPIF), Cost Reimbursement - No Fee Contract Line Items (CLINs).

Does this Solicitation include Cost Plus Fixed Fee (CPFF) contract types and, if not, can this FAR Clause be removed as it is only applicable to CPFF contract types.

See A0002, Section B revision

L.9 52.222–56 CERTIFICATION

REGARDING TRAFFICKING IN

PERSONS COMPLIANCE PLAN

(OCT 2020)

Page 69 This clause requires that offerors implement a Compliance Plan and conduct a certification, so please clarify the specific response required, if any.

There is no response due with the proposal.

The Contractor is expected to comply with the clause.

L.10 52.247-6 FINANCIAL

STATEMENT (APR 1984)

Page 69 Based on the requirements identified in the Solicitation PWS, it does not appear this solicitation is for transportation or for transportation-related services. The transportation of purchased supplies and parts between locations are incidental to the Maintenance and Logistics services and not a primary performance objective, so is this FAR Clause necessary?

The purpose of this clause is to ensure offerors are prepared to furnish financial statements if requested by the Government. So yes, the clause is necessary.

L.11 52.216-1 TYPE OF

CONTRACT (APR 1984)

Page 69 The Government contemplates award of a Hybrid

- FFP, CPIF, CPFF, Cost Reimbursable - No Fee contract resulting from this solicitation.

Section B.2 CONTRACT TYPE (OCT 2008), Page 12, specifies that “This is a Hybrid contract with Firm Fixed Price (FFP), Cost Plus Incentive Fee (CPIF), Cost Reimbursement - No Fee Contract Line Items (CLINs).

Does this Solicitation include Cost Plus Fixed Fee (CPFF) contract types or should "CPFF" be removed from this statement?

See A0002, Section B revision

PWS Section C.1.2.29

CDRL A038

38 The contract shall submit a draft Transition Plan at the start of the transition period of performance with the final plan provided not later than 30 days after the start of the transition period of performance (A038)

CDRL A038 Transition Plan requires Draft with Proposal. Final at POP Start + 30 days.

When does transition start, in accordance with the PWS or

CDRL A038?

Please clarify the start date for the 90-day transition period.

Transition period will start fairly soon after contract award and will be in the award document
