About this file

This is a NEPA Categorical Exclusion Form for a road improvement project on the Natchez Trace Parkway from MP 354.3 to MP 363.7 in Lawrence and Wayne Counties, Tennessee. The project will be managed by the Eastern Federal Lands Highway Division of the Federal Highway Administration.

The project involves reconstructing/rehabilitating approximately 9.4 miles of parkway, including a 1-inch overlay, mill and overlay of access ramps to Broadway Street, parking areas and bridges, along with patching, shoulder stabilization, signing, and pavement striping. The document details environmental compliance reviews, noting no adverse effects on historic properties, endangered species (including 7 federal-listed species), or wetlands. The project qualifies for categorical exclusion under 23 CFR 771.117(c)(22) as it takes place entirely within existing operational right-of-way. The environmental assessment found no mitigation measures were required, and the U.S. Fish and Wildlife Service provided a consistency letter on September 4, 2024 confirming no significant environmental impacts.

EFLHD NEPA Categorical Exclusion Form EFL-TM-ENV-03(04) NATR 1h11 1j16

Eastern Federal Lands Highway Division NEPA Categorical Exclusion Form

Project Number: NATR 1h11 1j16 Date: 9/4/2024

Project Name: Overlay Park Road from MP 354.3 to MP 363.7

Location: Natchez Trace Parkway Lawrence and Wayne Counties, Tennessee

CE Category 23 CFR 771.117 (c)(22): Projects, as defined in 23 U.S.C. 101, that would take place entirely within the existing operational right-of-way [...]

See 23 CFR 771.117 for full description of CE categories, including additional requirements when applying (c)26-28.

Project Description The project consists of the reconstruction/rehabilitation of the Natchez Trace Parkway (NATR) from milepost (MP) 354.3 to MP 363.7. The project consists of 1-inch overlay over NATR, including mill and overlay of the access ramps to Broadway Street, parking areas and bridges.

The work also includes patching, shoulder stabilization, signing, pavement striping, and other miscellaneous work. This project is being undertaken to repair the deteriorating infrastructure of the NATR to enhance safety and improve mobility for all users while reducing ongoing maintenance requirements and maintaining access to recreational opportunities and Parkway natural and cultural resources.

Environmental Commitments and Mitigation Measures No mitigation measures identified.

Summary of Section 7 of the Endangered Species Act Compliance The USFWS identified seven federal-listed species, two proposed species, and one candidate species with potential to occur within the project area. The list includes three bat species:

northern long-eared bat (endangered), gray bat (endangered), and tricolored bat (proposed endangered). One fish species is listed, the Boulder darter (endangered). Four clam or mussel species were also listed: Longsolid (threatened), round hickorynut (threatened), slabside pearlymussel (endangered), and Tennessee pigtoe (proposed endangered. One plant species, Price’s potato-bean (threatened) is listed. The monarch butterfly (candidate for listing) was also identified.

EFLHD NEPA Categorical Exclusion Form EFL-TM-ENV-03(04)

Given the nature of the project that involves road maintenance and no inwater work associated with the project, there is no potential to affect the fish or the clam and mussel species. All work will occur within the existing roadway so there is no potential to affect the Price’s potato-bean.

To evaluate impacts to northern long-eared bats and Indiana bats as a result of the proposed action, FHWA-EFLHD completed the effects determination key for the northern long-eared bat within the U.S. Fish and Wildlife Service (USFWS) IPaC system. The project activities are covered by the findings of the PBO for compliance with section 7(a)(2) of the Endangered Species Act (ESA). Through the use of the IPaC effects determination key, the proposed action would have no effect on these bat species. A consistency letter from the USFWS acknowledging this determination and that no consultation is required for these species was received on September 4, 2024. The proposed activities are anticipated to also have no effect on tri-colored bat and the gray bat given their similar habitats and life cycles.

Summary of Section 106 of the National Historic Preservation Act Compliance The NPS completed an Assessment of Actions Having an Effect on Historic Properties (approved on December 03, 2018), documenting that the proposed project would have no adverse effect on historic properties. The proposed actions would have no adverse effect on historic properties because all ground disturbance will be entirely within the existing operational right-of-way. Historic structures are in the area of potential effect (APE) but will not be adversely affected by the proposed projects. The Parkway’s designed historic landscape is present but will not be adversely affected by the proposed activities.
