About this file

This is a Buy American Certification document for construction projects funded by the Federal Aviation Administration (FAA) under the Airport Improvement Program (AIP), applicable to the Kenton County Airport Board's Backup Airport Operations Center (AOC) Construction project in Kentucky. The certification requires all bidders to comply with 49 USC 50101, mandating that all steel and manufactured goods used in the project be produced in the United States unless the FAA has issued a waiver, the product is listed as an excepted article under Federal Acquisition Regulation subpart 25.108, or the product appears on the FAA Nationwide Buy American Waivers Issued list. Bidders must select one of three certification options: committing to install only U.S.-produced steel and manufactured products; installing products with FAA-issued waivers; or installing excepted articles listed in FAA regulations. The apparent low bidder selecting waiver options must submit a formal waiver request with supporting documentation within 15 calendar days of bid opening, with failure to submit within this timeframe resulting in a non-responsive determination and proposal rejection.

The two waiver categories available to apparent low bidders are Type 3 waivers, requiring documentation that U.S.-produced components comprise more than 60 percent of the total item cost, and Type 4 waivers, requiring proof that total project costs using U.S. domestic products exceed costs using non-domestic products by 25 percent. Bidders selecting non-waiver options agree to provide evidence documenting the source and origin of steel and manufactured products, to comply faithfully with providing U.S. domestic products, to furnish U.S. domestic alternatives for any rejected waiver requests, and to refrain from seeking waivers after contract establishment unless extenuating circumstances emerge that the FAA determines justified. False certifications are subject to prosecution under Title 18, United States Code, as this certification concerns a matter within FAA jurisdiction per 49 USC 47126. All bidders must complete, sign, date, and submit the certification statement with their proposal as a requirement of bid responsiveness.
