About this file
This is a Bid Bond Form with Instructions document issued by the State of West Virginia's Department of Administration for use in response to Requests for Quotation (RFQs) and Requests for Proposals (RFPs). The form serves as a standard template for bidders to submit bid bonds as required by the state's purchasing procedures. The document does not specify particular products, services, quantities, response dates, site visits, bidder meetings, or contract terms, as it functions as a generic form applicable across multiple procurement opportunities issued by West Virginia state agencies.
The bid bond must be submitted by the Principal (bidding entity) and executed by a Surety licensed to transact surety insurance in West Virginia. The bond amount must equal a minimum of 5% of the total bid amount and serves as a guarantee that the bidder will execute a contract in accordance with the submitted bid if accepted. The Surety's liability is capped at the penal sum stated in the bond. The form requires the Principal's seal and signature from an authorized officer (President, Vice President, or Duly Authorized Agent), as well as the Surety's seal and an Attorney-in-Fact signature. A dated Power of Attorney with the Surety's seal must accompany the bond submission. The bid bond becomes null and void if the bid is rejected or if the Principal accepts the contract and fulfills all obligations as required.
