About this file

This is a Bid Bond template document for the State of West Virginia Department of Administration Purchasing Section. The document establishes the framework for bid bonds required as part of the state contracting process. While the specific contract details, project scope, quantities, timelines, and award dates are not populated in this template document, the bid bond serves as a financial guarantee mechanism that bidders must submit with their proposals to demonstrate good faith intent to enter into a contract if their bid is accepted.

The bid bond requires the principal (bidder) to secure a surety bond from a West Virginia-licensed surety insurance company. The penal sum of the bond is to be determined based on the specific bid amount and contract requirements. The surety's liability is limited to the stated penal amount, and the surety waives notice of any extension of the bid acceptance period. The document must be executed by a proper officer of both the principal and surety, with the surety required to affix its seal and attach a power of attorney with seal affixed. Failure to meet contract obligations, furnish required bonds and insurance, or perform according to the accepted bid renders the bond enforceable; conversely, if the bid is rejected or all conditions are met, the bond obligation becomes null and void.
