1.2 WORK COVERED BY CONTRACT DOCUMENTS

A. Project Location:

1. Schedule 1: St Mary Water System Improvements: Glacier National Park, St. Mary

Camp Ground and Hudson Bay Housing Area, St. Mary Village, Montana. The St.

Mary complex is the major hub for the National Park Service (NPS) operations on the east side of Glacier National Park. This water system provides potable water and firefighting water for all the National Park Service (NPS) offices and shops in the area, as well as the

NPS employee housing adjacent to the complex. This system serves 100 NPS employees and thousands of visitors each year.

2. Schedule 2: St Mary Winter Septic System Improvements: This project will include gravity sanitary sewer collection piping, replacement wastewater treatment system (level 2), effluent dose tank with pumps, effluent force main, a subsurface drainfield disposal system, electrical improvements, and abandoning the existing winter septic system.

3. Schedule 3: Two Medicine Campground and Day Use Area, Montana. Two Medicine is a popular yet remote destination on the East Side of Glacier National Park. This system provides potable water for staff, a seasonal campground, a historic general store, and day

users. The amenities at the project location are active only in the summer and inaccessible through the winter.

B. Schedule 1 (St Mary Water) Work consists of:

General: This project will include improvements to the one of two existing wells, replacement of a second existing well, abandonment of an existing well, replacement of the water distribution system and appurtenances in the Hudson Bay area, replacement/relocation of the existing well control and water treatment building and equipment in the Hudson Bay area, replacement of the water distribution system and appurtenances within the St. Mary Campground and abandonment of the existing water storage tank above the St. Mary Campground.

1. Replace and properly abandon one of the two existing wells that was found to have a damaged casing in overall deteriorated condition.

2. Replace the submersible pump and riser pipe equipment in the second, existing well located inside the existing treatment and control building.

3. Replace the water distribution piping in Hudson Bay, including a new distribution loop within the existing roadways in lieu of replacing the existing pipe within the congested area among the buildings and other utilities.

4. Replace the water distribution system within the St Mary Campground.

5. Compact waterline trenches and disturbed road surfaces for subsequent pavement restoration, in contract or by others (Option 1A below).

6. Remove asphalt to limits indicated in the drawings.

7. Complete turf preparation for restoration by NPS.

8. Complete gravel restoration.

9. Abandon the water tank in the St Mary Campground.

10. St Mary (Hudson Bay) Tank: Replace ladders, add check/flapper valve to overflow.

11. Option 1A: Asphalt Restoration

a. Remove temporary trench patch

b. Prepare base and complete asphalt paving.

c. Place topsoil on edge of asphalt roadways for revegetation by NPS.

C. Schedule 2 (St Mary Winter Septic) Work consists of:

1. This project will include gravity sanitary sewer collection piping, replacement wastewater treatment system (level 2), effluent dose tank with pumps, effluent force main, a subsurface drainfield disposal system, electrical improvements, and abandoning the existing winter septic system.

2. Compact pipeline trenches and disturbed road surfaces for subsequent pavement restoration, outside of this contract/schedule.

3. Remove asphalt to limits indicated in the drawings.

4. Complete turf preparation for restoration by NPS.

5. Complete gravel restoration.

D. Schedule 3 (Two Medicine Water) Work consists of:

1. General: This project will include improvements to two of three existing wells, abandonment of a second existing well (Well #2), replacement of the water distribution system and appurtenances in the Two Medicine Campground, Day Use Area, replacement/relocation of the existing well control and water treatment building and equipment, and removal of the unused existing water storage tank adjacent to the current tank.

2. Properly abandon one of the two existing wells (Well #2) that is not used for water supply.

3. Complete improvements to existing Well #1.

4. Install level transducer access tube into Well #3 and add manual electrical transfer switch at the well head.

5. Abandon and remove the water tank south of the existing treatment building.

6. Demolish the existing well control and treatment building and replace with new building, chlorination equipment, and backup generator.

7. Rehabilitate the existing bolted steel tank.

8. Replace the water distribution piping in Two Medicine Campground and Picnic Area, including a new transmission main on the south side of Two Medicine Road.

9. Compact waterline trenches and disturbed road surfaces for subsequent pavement restoration, in contract or by others (Option 3A below).

10. Remove asphalt to limits indicated in the drawings.

11. Complete turf preparation for restoration by NPS.

12. Complete gravel restoration.

13. Provide temporary well pump controls and chlorination provisions to maintain water service to the Day Use area during construction.

14. Option 3A: Asphalt Restoration

a. Remove temporary trench patch

b. Prepare base and complete asphalt paving.

c. Place topsoil on edge of asphalt roadways for revegetation by NPS.

E. Project will be constructed under a single prime contract.

1.3 WORK PHASES

A. Schedule 1 (St Mary Water): The work shall be conducted in two phases in the following order, with each phase substantially complete before beginning next phase:

1. Groundwater Well Construction (Phasing Requirements) Construct and commission the new well control and treatment building before demolishing the existing well control and treatment building and modifying the existing well

a. Phase 1: Construction of the new well and completion of pump testing must commence immediately upon start of construction. The pump testing information is necessary to finalize the well pump size and secure final MT Department of Environmental Quality approval for the well and associated equipment. Thus, the well pump, generator and other affected equipment in the project drawings and specifications is the �Basis of

Bid� equipment. The equipment may need adjusted depending on the results of the pump testing. The Contracting Officer will provide either verification or required modifications information to the contractor for subsequent procurement. Equipment submittals for associated equipment will not be reviewed until the well testing information and final equipment sizing is provided to the Contractor.

b. Phase 2: Demolish the existing treatment/control building and complete the modifications to the existing Well #1.

2. Water Distribution System (Hudson Bay Area):

a. Construct new water distribution system while maintaining the existing active water system during construction.

b. Following completion of testing and acceptance of the new mains, begin switchover of building connections to the new system.

B. Schedule 2 (St Mary Winter Septic)

1. Phase 1: Location and modification of the existing force main conveying wastewater from St.

Mary Village to the wastewater treatment facility. A section of this force main will be adjusted to allow for the construction of the gravity sewer system improvements.

2. Phase 2: Construction of the gravity sanitary sewer mains, wastewater treatment system (level

2), effluent dose and force main, and subsurface drainfield. There are no seasonal time restrictions for the construction of Phase 2. Phase 2 shall be substantially complete by

September 30th, 2026.

3. Phase 3: Abandonment of the existing 16,000-gallon and 8,000-gallon wastewater treatment septic tanks as shown. Work for this phase shall commence upon substantial completion of

Phase 2 and shall be completed within 30 calendar days.

4. See additional provisions under �CONTRACTOR USE OF SITE� below.

C. Schedule 3 (Two Medicine Water) The Work is generally envisioned for construction in the following phases, subject to the Contractor�s work plan and restrictions noted in the specifications.

1. Phase 1

a. Set up temporary electrical well controls and chlorination system.

b. Demolish existing treatment/control building and abandoned tank and construct new building.

c. Complete modifications to existing Well #1.

d. Construct water distribution system loops A, B, C.

e. Construct new water transmission main from near the campground entrance road intersection to near the access road to the tank and treatment/control building.

2. Phase 2:

a. Complete existing tank rehabilitation.

b. Complete electrical modifications to Well #3.

c. Finish water transmission main from new building to the connection to the distribution system near the ranger station.

d. Construct the water main through the picnic area.

e. Construct the water main through the day use area.

f. Complete surface restoration.

3. See additional provisions under �CONTRACTOR USE OF SITE� below.

1.4 WORK UNDER OTHER CONTRACTS

A. General: Cooperate with separate contractors so work on those contracts may be carried out smoothly, without interfering with or delaying work under this Contract. Coordinate Work of this Contract with work performed under separate contracts.

B. Existing NPS Operations: The existing operations and maintenance team, along with the park�s concessioners, will remain in operation during the allowed times set by the GNP. Contractor shall conduct work to have minimal impact to these facilities and their operations.

C. Existing Concessionaires: The existing park concessioners will remain in operation during the allowed times set by the park. Contractor shall conduct work to have minimal impact on these facilities and its operations.

D. Other NPS Operations: NPS conducts other Park operations for official and visitor purposes. Contractor shall conduct work to have minimal impact on these operations and visitor experience.

E. Preceding Work: None.

F. Concurrent Work: Two Medicine Road Improvements (FHWA).

G. Future Work: Two Medicine Road Improvements (FHWA).

1.5 GOVERNMENT-FURNISHED MATERIALS

A. None

1.6 CONTRACTOR USE OF SITE

A. General:

1. The Contractor shall keep the site neat and orderly at all times. Schedule regular

�housekeeping� to ensure this. The site must always be free of wildlife attractants and potential hazards to NPS and visitors. The Contractor and all personnel on-site are to reference, understand and abide by the Bear, Wildlife, and Sanitation Requirements While

Working in Glacier National Park, A Handbook for Construction Personnel, 2024.

2. Contractor will have physical access to the work areas as follows:

a. Schedule 1 St Mary Water (Area 01 � Hudson Bay)

1) Except as noted below, no specific access restrictions are included for work around the Hudson Bay area outside of normal coordination of work in this residential area, and as described in the specifications for maintaining water service and admin/vehicle access.

2) Coordinate with Contracting Officer to maintain access to the admin/maintenance area at all times. Refer to construction drawings (Sheet PP3

�connection notes�) for access provisions to maintain access to this area during construction of the connections to the existing water distribution system.

a) Temporary access at the south end of Hudson Bay can be enabled between the �South RV Loop� and the south end of the admin/maintenance area between waterline stations 219+00 and 221+50.

b) This temporary access may be required during construction of the waterline between stations 208+50 to approximately 218+00 to provide egress to/from the buildings between these stations.

c) Maintain the bypass within the designated construction limits.

d) Provide and maintain suitable and safe road base driving surface for the needed duration of the bypass.

e) After the bypass is no longer needed, remove any imported road base material and restore surface in preparation for revegetation by NPS, including scarifying the surface and applying topsoil.

f) Most of this proposed bypass is also a pipeline trench corridor. Surface disturbance outside of the pipeline trenching corridor through this area will require additional surface restoration preparation to allow NPS restoration of affected turf and vegetation. Compacted turf areas will require scarifying and topsoil application to restore to pre-existing grade and provide a surface ready for seeding and restoration.

3) Minimize the length of trench left open and impeding traffic at any time to less than 100 lineal feet unless otherwise coordinated and approved by the

Contracting Officer.

4) Contractor is to maintain access to the shooting range at the south end of Hudson

Bay. The shooting range is heavily used in the spring and fall with intermittent use in the summer. Contractor is to coordinate with Dave Smith (406-732-7715) or Kristine Simpson (406-732-7730) to maintain access to the shooting range.

5) Horse Corral area: The driving access to the horse corrals is used daily in the summer to load and unload livestock. Waterline installation work that will block access to the corrals will need to be closely coordinated with the Contracting

Officer to maintain access. Do not block access to the corrals unless and until this coordination has been completed.

6) Water Service Connections (inside existing structures): interior building water service reconnections, where required, will require advance notice to the

Contracting Officer for coordination with the occupants and cultural resources personnel to review the contractor�s proposed plan for reconnection inside the structures.

a) Initial access to review the building interiors will be provided following two weeks� notice to the Contracting Officer to coordinate building entry.

b) Contractor to provide conceptual connection plans/descriptions for the water service connections inside the structures for Contracting Officer and cultural resources review. Allow two weeks for CO to approve the proposed connections.

c) For entry into the buildings to make the service line connections, provide at least 5 days� notice to CO to coordinate with occupants/residence for entry into the buildings.

b. Schedule 1 St Mary Water (Area 02 � Going to the Sun Road (GTSR) and St Mary

Campground)

1) Work on GTSR cannot be done from July 1 to September 30. Contractor to maintain traffic during this time. Traffic hold restriction is set to 10 minutes.

2) Full Campground closure allowed from January 1 to June 19, 2026 to accommodate construction.

c. Schedule 1 (Area 03 � St Mary Visitor Center)

1) No work can commence while the Visitor Center is open to the public. Work can proceed around the Visitor Center until May 11, 2026 and after October 10, 2026.

2) Contractor to maintain access for seasonal opening/closing operations to NPS to perform start-up/shut-down operations.

d. Schedule 2 (St Mary Winter Septic)

1) Work on this project is not impacted by visitation and can proceed weather permitting.

2) The force main relocation shall be completed upon the NPS winterization/draining of the force main, between October 1st and April 30th.

3) Substantial completion by November 1, 2026, for use in winter.

e. Schedule 3 (Two Medicine) � 2026 Season:

1) The Two Medicine Campground (Loops A, B, C) will be under a full closure to public access and available for construction.

2) The Day Use Area (concessionaire area, general store, and boat ramp) and

Picnic Area, including the Ranger Station, must remain open to administration and public use during normal visitation season, May 22 to September 8.

a) Public water supply must remain available in 2026. Temporary water system and chlorination provisions to be in place by May 10, 2026 in order for the system to be tested and ready for public use for the summer.

b) Temporary water system controls and chlorination provisions and requirements are included in the construction documents.

c) The Picnic Area needs to remain open, but water supply does not need to be maintained in this picnic loop area during this time. Campground Loop

A (without water) can be used as a day use picnic area in place of the picnic loop to facilitate construction sequencing. Either the picnic loop or Loop A must be available for picnic/day use during the visitation season.

d) Contractor to maintain access for seasonal opening/closing operations to

NPS to perform start-up/shut-down operations.

3) 2027 Season:

a) Water system to be commissioned and handed over to NPS by May 10, 2027.

4) Option 3A: Asphalt Paving

a) Phase asphalt paving work so no two adjacent campground loops are impacted at one time.

b) Remaining work (i.e. paving, final grading restoration) and site cleanup complete by 06/30/2027.

B. Limits: Contractor shall have limited use of site for construction operations. Limit use of premises to limits of construction indicated on drawings. Do not disturb portions of Project site beyond areas in which the limits of construction are delineated.

1. Hot asphalt products will not be produced within the park boundary.

2. The Contractor shall use the Contractor Support Facilities to the maximum extent practical based on the following project objectives:

a. Minimize traffic impacts associated with Contractor staff entering/exiting the Park.

b. Allow for continuity of staff, NPS access to Contractor staff, and emergency preparedness during construction.

c. Mitigate inherent safety issues associated with the remote work site(s) and commuting from remote locations.

3. Use of Contactor Support Facilities: The following facilities are to be used and maintained by the Contractor:

a. Contractor Trailer Parking

1) One (1) Construction trailer is allowed for the project for the use of the

Contractor and CO.

2) Contractor vehicle parking area for contractor personnel and construction vehicles. Contractor shall provide American with Disabilities Act (ADA) accessible spaces and sidewalks as required for construction operations and submit for Developmental Services Center (DSC) approval, if required by

Construction Management Representative (CMR).

b. Contractor Operations and Laydown Area

1) See plans for more information.

c. Refer to the plans for additional information and locations of facilities.

C. Storage of Materials: Confine storage of materials to designated staging areas shown on plans.

1. Materials, tools, and equipment shall not be stored in existing park facilities.

2. Materials shall not be stored in a location that obstructs foot or horse traffic on Park trails.

3. Storage and equipment parking areas will be kept clean and orderly. Materials and equipment etc. Stored at staging areas must remain within the disturbance footprint of the staging area

(e.g., materials and equipment must not encroach beyond the approved disturbance footprint into surrounding vegetation).

D. Parking: Confine parking to staging areas and construction limits shown on drawings, and as approved by the CO.

E. Stockpiling: Confine stockpiling to designated staging areas and within construction limits shown on project drawings. Refer to the contract documents for stockpiling size and height restrictions.

F. Preservation of Natural Features:

1. Prevent damage to natural surroundings. Restore damaged areas to the extent noted herein, including; repairing or replacing damaged trees and plants, at no additional expense to the

Government. Damaged areas shall be prepared for restoration; topsoil must be conserved for replacement and, prior to restoration, spread over disturbed areas to prepare the site for restoration; and compacted areas must be scarified.

2. Provide temporary barriers to protect existing trees and plants and root zones.

3. With the exception of the tree removal defined on the Contract Drawings, do not remove, injure, or destroy trees or other plants without prior approval. Consult with Contracting

Officer (CO) and remove agreed-on roots and branches that interfere with construction.

4. Do not fasten ropes, cables, or guys to existing trees.

5. Carefully supervise excavating, grading, filling, and other construction operations near trees to prevent damage.

G. Driveways and Entrances: Keep driveways, trails, and entrances serving premises clear and available to

Government employees, hikers, and emergency vehicles at all times or per approved traffic control plans to accommodate necessary construction. Do not use for parking or storage of materials.

1. Schedule deliveries to minimize impacts to visitors.

2. Schedule deliveries to minimize space and time requirements for storage of materials and equipment on-site.

3. No project activity is permitted outside the project area, including the backcountry.

H. Construction Camps: Establishment of a construction camp within park is prohibited. Project personnel will not camp within the park. Accommodations must be secured outside of Glacier National Park boundaries.

I. Dogs: No dogs are allowed on-site.

J. Hauling Restrictions: Comply with all legal load restrictions in the hauling of materials. Information regarding rules and regulations for vehicular traffic on park roads may be obtained from the Office of the Park Superintendent. The Contractor shall be liable for damage which directly results from moving of equipment.

1. Hauling vehicles greater than 20,000 gross vehicle weight travelling within the park between sunset and sunrise will be limited to speeds of no more than 10 miles per hour (mph) below the posted speed limit.

2. Loads shall not exceed state highway loading on park roads.

a. Access to the project site will involve using existing bridges. Comply with the bridge inspection report and load ratings.

b. Submit overload and oversize permits for non-legal loads transported within the park boundary to the CO utilizing the FLH Bridge Oversized or overload vehicle permit request form. The Government will make the form available under FAR Clause 52.236-

4 � Physical Data. Allow 14 days for review of the permit application.

3. Deliveries to the site for the project shall be limited to weekday hours between 7:00 AM and

6:00 PM, and no Holiday deliveries are permitted. Any deliveries outside of these restrictions shall be approved by the CO.

4. Heavy equipment access should be carefully considered and all loads entering and exiting the park shall be covered to ensure wildlife and visitor safety.

1.7 PUBLIC USE OF SITE

A. Contractor shall at all times conduct operations to ensure the least inconvenience to the public and residents.

B. The St Mary Campground and St Mary Visitors Center will be seasonally closed to the public, when construction is anticipated.

C. Hudson Bay Housing area will be open to the residents with services maintained to the permanent residences throughout construction with minimal disruption.

D. Hudson Bay Housing temporary road closures may be permitted, when required, upon specific approval of Contracting Officer (CO).

E. The Two Medicine boat ramp, general store and concessionaire area, ranger station, and employee housing will remain open during normal visitation season.

F. The Two Medicine Campground will be closed to the public, when construction is anticipated.

1.8 OCCUPANCY REQUIREMENTS FOR BUILDINGS

A. Existing Buildings and Facilities

1. Cooperate with Government during construction operations to minimize conflicts and facilitate Government usage, should access to facility be needed during construction.

Perform the Work so as not to interfere with Government�s operations and operation of the concessioners. Maintain existing exits, unless otherwise indicated.

2. Maintain access to existing walkways, corridors, and other adjacent occupied or used facilities. Do not close or obstruct walkways, corridors, or other occupied or used facilities without written permission from the CO.

B. New Buildings

1. Government Occupancy of Completed Areas of Construction: Government reserves right to occupy and to place and install equipment in completed areas of building, provided such occupancy does not interfere with completion of the Work. Such placement of equipment and partial occupancy shall not constitute acceptance of the entire project.

a. Contracting Officer will prepare a Beneficial Occupancy letter for each specific portion of the Work to be occupied before Government occupancy.

b. Obtain a Certificate of Occupancy from National Park Service (NPS) before

Government occupancy.

c. Before partial Government occupancy, mechanical and electrical systems shall be fully operational, and required tests and inspections shall be successfully completed. On occupancy, Government will operate and maintain mechanical and electrical systems serving occupied portions of building.

d. On occupancy, Government will assume responsibility for maintenance and custodial service for occupied portions of building.

1.9 CONDUCT OF OPERATIONS

A. Contractor shall conduct his operations in conformance with rules and regulations promulgated by the

Secretary of the Interior for the National Park Service, and applicable park rules and regulations prescribed by Park Superintendent.

B. Work on Saturdays, Sundays, Federal holidays or at night may not be performed unless stated in the

Work Restrictions below or without prior consent from the Contracting Officer. Submit requests 5 business/calendar days in advance of the work to the Contracting Officer for approval.

C. No signs or advertisements (except those specified herein) shall be displayed on the construction site or within the park unless approved by the Contracting Officer.

1.10 WORK RESTRICTIONS

A. On-Site Work Hours:

1. Work shall be generally performed during normal business working hours of 7:00 a.m. to

6:00 p.m., Monday through Friday during the months of April 1 through December 31 each year unless otherwise approved by the CO.

a. If weekend work is required: Specific hours will be determined on a case-by-case basis when obtaining consent for weekend work from the CO.

2. Low traffic and low visitor times are weather dependent, but are generally from mid-April, once the roads are cleared of snow until concessioner operations open in early June.

3. Hours and workdays for noise intensive activities including rock screening, crushing and similar activities shall be coordinated with the CO a minimum of 72 hours in advance.

4. Night work will not be permitted as part of this project.

a. Park quite hours are between 9:00 PM and 6:00 AM. All work within this timeframe shall be approved by the CO in advance.

b. In the event night work is required, night work must be approved by the CO. Safety, visitor impacts, and resource impacts would be reviewed before any approved night work can occur. Refer to 01 50 00 for night work mitigation measures.

B. Existing Utilities

1. Existing Utilities:

a. Existing utilities shown on the Drawings are based on data available from the NPS including previous projects and/or geographic information system data. Contractor is responsible for confirming/locating every service tie-in. Additional surveying is required.

1) Contractor shall have locating equipment (preferred GPR or other non-metallic pipe locating equipment) and skilled personnel to operate it.

b. Notify the CO and utility companies of proposed location and times for excavation.

c. CO needs to be notified about any unforeseen conditions or anything like a damaged unknown utility, before the contractor is authorized to fix it.

2. Contractor shall be responsible for locating and preventing damage to known utilities. If damage occurs, repair utility at no additional expense to the Government.

3. If damage occurs to an unknown utility, repair utility. An equitable adjustment will be made in accordance with the Changes clause of the contract.

C. Existing Utility Interruptions: Do not interrupt utilities serving facilities occupied by Government or

Government Leases including Concessioners unless permitted under the following conditions and then only after arranging to provide temporary utility services according to requirements indicated:

1. Notify Contracting Officer not less than seven days in advance of proposed utility interruptions.

2. Do not proceed with utility interruptions without Contracting Officer�s written permission.

3. Hours and length of Utility Shutdowns: Only emergency utility shutdown will be allowed and immediate notification to Contracting Officer will be required. To be determined on a case-by-case basis with the CO.

4. Refer to Specification 01 73 40 for specific coordination requirements associated with water outages, scheduling, and timing.

5. Shutdown duration: Utilities shall not be disconnected and out of operation for more than 5 hours without CO�s written permission. A contingency plan shall be in place to re-instate service if work cannot be completed as planned.

6. Contractor will be responsible for the development and submittal of a Water Service

Management Plan

a. Submit and maintain a narrative plan with supporting drawings for coordination with the NPS in maintaining water utility services. The plan shall be developed for the following areas of work:

1) Hudson Bay water system

D. Nonsmoking Building/Tobacco Use/Vaping:

1. Smoking, including vaping, is prohibited in the backcountry of Glacier National Park, and inside any structure including buildings.

2. Smoking is permissible outdoors in designated smoking areas only.

1.11 SPECIAL CONSTRUCTION REQUIREMENTS

. Project Website: A project website administered by NPS will be used for purposes of managing communication and documents during construction stage.

1. See Section 01 31 00 "Project Management and Coordination" for requirements on using

Project Website.

1.12 Hazardous Material:

A. All handling and disposal of asbestos containing materials (ACM) must comply with current regulations.

1. Contractor shall follow the Asbestos Control Act of the Montana Department of

Environmental Quality (DEQ) for any applicable Work.

B. Prior to any demolition of any ACM or LBP, the following abatement activities shall be completed:

C. Contractor to submit a workplan identifying a workplan for the removal and disposal of hazardous material. All means, methods, and locations of disposal shall be provided.

D. Identify who will be completing the work, and their licensure to do so as well as all the regulations that will be followed as part of the plan.

E. Contractor to submit technical specifications for abatement, removal and proper disposal of ACM

F. Lead base paint: Presence of lead based paint is unknown. If encountered, coordinate with the CO regarding removal and disposal provisions.

PART 1 - GENERAL

1.1 SUMMARY

A. Section consists of administrative and procedural requirements for contract modifications.

1.2 DEFINITIONS AND ALLOWANCES

A. Home Office Overhead: Costs incurred in support of all of a contractor�s projects and not attributable to a specific job. The cost for home office overhead is only allowed as a percentage of all direct work excluding profit. The following items represent allowable home office overhead costs identified in Part 31 of the Federal Acquisition Regulation (FAR):

1. Rent

5. Executive and management staff not exclusively assigned to the project

B. General Conditions (Field Office Overhead): Management and administrative costs incurred on site for the designated project. Costs associated with preparation of modifications will not be allowed. Costs for these items are to be included only in the general conditions of the modification estimate. Only in the case of a contract time extension are additional general conditions included in modifications. The following items, if applicable, are considered allowable costs for calculating General Conditions:

D. Personnel Costs: Costs included in the modification must only be for General Conditions staff and workers actually present and working on project site. Modification costs for salaried workers are only allowed within the structure of a 40-hour week and no overtime or holiday pay will be allowed.

1. Worker Hourly Rates are costs directly associated with the individual worker and consist of the following:

a. Base Rate: The hourly rate paid directly to the worker

b. Labor Burden: Employer payments of all applicable burdens; includes insurance and taxes the business must pay on behalf of the worker to government entities and educational forums, such as:

1) Social Security

3) Workers Compensation � Policy and company calculation to be made available.

4) Federal Unemployment Tax Act (FUTA) - Cap Rate and percentage to be proportionally allocated over one year.

6) Union agreement costs - Other costs required under an enforceable collective bargaining agreement.

c. Fringe Benefits: Various non-wage compensations provided to employees such as:

4) 401K and Pensions

5) Vehicle allowances

6) Gas allowance

7) Life insurance premiums

8) Disability insurance

9) Other Fringe Benefits required under an enforceable collective bargaining agreement

E. Bonuses or Deferred Compensation: No Bonus or Deferred Compensation will be allowed within any components of pricing including Home Office Overhead, General Conditions, General Requirements, Hourly Worker Rates, or the direct costs of work.

F. General Liability Insurance: An insurance policy that protects Contractor from claims resulting from bodily injury or property damage to a third party. Include as a separate line item within all modification proposals and provide a current insurance quote upon request.

G. Performance and Payment Bonds: A performance bond is a surety bond issued by an insurance company or bank to guarantee satisfactory completion of a project. The Payment Bond guarantees the Contractor will pay the labor and material costs incurred. Banks and Insurance companies charge a premium for individual project based on a sliding scale related to the size of the project.

Include as a separate line item in modification proposals and provide current company bonding rates upon request.

H. Builder�s Risk Insurance: Covers the contractor�s loss due to fire, high winds, or other natural forces. Not reimbursed by the National Park Service (NPS) and shall not be included in modification proposals.

1.3 MODIFICATION PROPOSAL PRICING REQUIREMENTS

A. General:

1. Proposal be received in the format and within the time frame specified in the Request for Proposal (RFP) letter. Costs or delays resulting from failure of contractor to submit within the time frame specified will not be compensable.

2. Proposal shall be detailed with itemized lists of equipment, materials, labor, production rates, overhead, profit, and bond markup for each item. Labor costs must be itemized by craft and hourly rate, including Fringe Benefits and Labor Burden. If the costs of Fringe Benefits and Labor Burden are not itemized, it is assumed they are included in the hourly rate shown, or contractor is not requesting reimbursement. Contractor may utilize the government provided Contractor Estimate Form, or their own form, provided that it contains the same information and level of detail as the Government�s form.

3. Requests for extensions of contract time as a result of change must be justified with a Time Impact Analysis (TIA). Refer to Section 01 32 16 "Construction Schedule", for time impact analysis requirements. TIA and associated costs shall be received with the proposal by the date shown within the Request for Proposal letter. Contractor�s failure to submit within the specified time frame will be construed as the Contractor waiving right for additional time and no time extension will be allowed.

4. All supporting documentation used to justify the proposed modification will be made available to the Contracting Officer (CO) upon request.

5. Contractor shall review and approve all subcontractor/supplier pricing in detail for proper format, scope, production rates, and pricing prior to submission to NPS. All delay costs associated with not reviewing and approving subcontractor/supplier pricing will be borne by the Contractor.

6. All pricing and production rates within the estimate must be based on fair and reasonable pricing and cannot include built-in contingency.

B. Labor:

1. Contractor shall estimate cost of labor by itemizing each craft involved, indicating worker hourly rate (base rate + labor burden + fringe benefits) for each and itemizing hours required for each craft directly engaged in modification work. Any work proposed requiring overtime work or premium pay shall be itemized separately. Rates shall be in accordance with the Davis-Bacon Act as incorporated herein. Labor Burden may include payroll taxes, Social Security, unemployment insurances, workers compensation insurance, Federal Insurance Contributions Act (FICA), FUTA, and other direct costs resulting from Federal, State or local laws.

2. Itemize labor costs for equipment operators separate from equipment costs.

3. Labor cost for foremen shall only be costs for related work required for the modification.

C. Materials:

1. Estimated cost for materials shall include quotes from multiple sources. Material prices shall include applicable fees and credits, including but not limited to, sales tax, freight and delivery charges, and tax rebates.

2. No markup shall be applied to any material provided by NPS.

D. Equipment:

1. Equipment used for the project must be appropriately sized for work being performed.

2. Do not include costs for "miscellaneous tools and equipment", in your proposal for a replacement value of $500 or less. Costs shown in excess of $500 shall be broken out separately.

3. Regardless of ownership, rates to be used in determining equipment rental costs shall be the lowest cost from one of the following sources:

a. United States (U.S.) Army Corps of Engineers, Ownership and Operating Expense Schedule (use latest edition and applicable region)

b. Construction Blue Book

c. Local equipment rental rates, documented by actual invoice charges, or itemized vendor quotes.

4. Estimated equipment rates shall include operating costs of all fuel, oil, lubrication, supplies, small tools, necessary attachments, ground engaging components, tires and tracks, routine repairs and maintenance (cost of major repair and overhaul is not allowed per Federal Acquisition Regulation (FAR) 31.105(d)(2)), depreciation, storage, insurance, and all incidentals. Mobilization, if applicable, may be included for equipment solely used on the modification work but must be listed separately.

5. Estimate full rate for equipment only for duration that equipment will be utilized to accomplish work of the modification.
