About this file

This file is a collection of construction drawings and environmental compliance documents for the Knife River Elbee Bend Bank Stabilization Project (KNRI 257081) located at Knife River Indian Villages National Historic Site in Stanton, North Dakota. The project involves riverbank stabilization on the Knife River including site preparation, erosion control, temporary river crossing, excavation, rock installation, grading, material import, stockpiling, compaction, seeding, and restoration work. The estimated project start date is June 2, 2025, with completion targeted for June 12, 2026. Approximately 19 acres total site area with 18 acres of disturbance are anticipated. The project owner is the National Park Service (contact: Thomas Smith at 505-240-0336), and the project is being managed by Stantec Consulting Services Inc. as the prime civil engineering and design firm.

The documents establish comprehensive environmental compliance requirements under North Dakota's general construction stormwater permit (NDR10-0000/NDR11-0000), including a detailed Stormwater Pollution Prevention Plan (SWPPP), Notice of Intent (NOI), Notice of Termination (NOT), and site inspection templates. Key environmental considerations include impacts to palustrine and riverine wetlands (temporary: 0.45 acres palustrine, 2.17 acres riverine; permanent: 1.00 acre palustrine, 0.94 acres riverine), with proposed mitigation through restoration of 1.63 acres of palustrine and 3.16 acres of riverine wetlands. The Knife River is listed as an impaired water body due to E. coli contamination, necessitating implementation of additional best management practices. Construction sequence requirements mandate daily completion and stabilization of channel sections to minimize sediment discharge, with erosion control measures including silt fencing, temporary oil booms, silt curtains, erosion control blankets, and matting. The contractor must obtain county road approach permits, comply with North Dakota OneCall utility locating requirements, implement construction entrances with sediment tracking controls, and maintain comprehensive inspection records throughout the project duration.

Y N Are there any sediment basins where collected sediment has reduced the storage capacity by 1/2? (Drainage and removal must be completed within 72 hours.)

Y N Is there evidence of sediment deposits in surface waters, drainage ditches or other stormwater conveyance systems? (Removal and stabilization must be completed within 7 days unless prohibited by legal, regulatory or physical access constrains. All reasonable efforts must be made to obtain access. Once permission is granted, removal must take place within 7 days.)

Y N NA Is there evidence of sediment being tracked off-site by vehicles or equipment? (Sediment tracked or deposited on paved surfaces must be removed within 24 hours.)

(These types of discharges are not covered by the construction general permit, NDR10-0000. They must be stopped immediately if they are not covered by another type of permit. The following non-stormwater discharges are allowable if the appropriate prevention measures are in place: fire-fighting, fire hydrant flushing, potable water line flushing, infrequent building and equipment wash down without detergents, uncontaminated foundation drains, springs, lawn watering and air conditioning condensate. Please note that discharges from temporary dewatering activities, such as hydrostatic testing or disinfection of new pipelines may require coverage under the temporary dewatering general permit, NDG07-0000.)

Y N Is there evidence of wash water from tools or equipment draining to waters of the state, drainage ditches or storm sewer systems?

Are permanent stormwater management measures (e.g., oil-water separators, rain gardens) functioning properly?

Indicate which condition has been met before submitting the NOT.

If another operator/permittee has assumed control in accordance with the transfer provision (Part I(F) of the permit over all areas of the site that have not achieved final stabilization please file a Notice of Transfer/Modification Form (SFN 54242)).

The site has achieved final stabilization. In order to achieve final stabilization, one of the following conditions must be met. Please indicate which condition has been met.

All soil disturbing activities are complete and all soils are stabilized by a uniform perennial vegetative cover with a density of 70 percent of the pre-existing cover over the entire pervious surface area, or other equivalent means necessary to prevent soil failure under erosive conditions and;

i. All drainage ditches which drain water from the site have been stabilized;

ii. All temporary erosion prevention and sediment control BMPs (e.g., silt fence) have been removed; and

iii. All sediment has been removed from conveyances and temporary sediment basins used for permanent water quality management, and the sediment has been stabilized. The clean out of permanent basins must be sufficient to return the basin to design capacity.

For areas with an average annual rainfall of less than 20 inches, all soil disturbing activities at the site have been completed and erosion control measures and stabilization methods have been selected, designed and installed along with an appropriate seed base to provided erosion control for three years and achieve 70 percent vegetative coverage within three (3) years without active maintenance. Sites must meet the conditions above.

Disturbed areas on land used for agricultural purposes that are restored to their pre-construction agricultural use are not subject to these final stabilization criteria. If the construction activity removed standing crop, the area must be restored in accordance with the landowner.

Areas disturbed that were not previously used for agricultural activities, such as buffer strips immediately adjacent to waters of the state, and areas which are not being returned to their pre-disturbance use must meet the final stabilization criteria above.

For residential construction, all lots have been sold with temporary erosion protection and down gradient perimeter controls installed; a homeowner fact sheet has been given to the homeowner(s); and all other lots have achieved final stabilization.

Greetings Kris Neset, Reference: Knife River 257081 Elbee Bend Section 402 Permit Submittal

Stantec has prepared draft documents for the awarded Contractor to review and submit to the North Dakota Department of Environmental Quality (DEQ) Water Quality Division (WQD). The Contractor is responsible for preparing, obtaining, and complying with the General Construction Stormwater Permit (NDR10-0000) for the Knife River Elbee Bend Riverbank Stabilization Project. The documents in the CDs (specifically Sheets 3, 6-7) and those included in the transmittal are intended to serve as supplemental information.

There are specific nuances associated with this permit, such as the review of the North Dakota Department of Health's Surface Water Program 303(d) list of impaired water bodies, Total Maximum Daily Loads (TMDLs), and soil maps. These factors necessitate certain considerations in the design of minimum best management practices (BMPs) to be incorporated into the project design.

The following information is included for your review and acceptance to include in the final CDs:

• Notice of Intent (NOI) with Project information filled out,

• Draft Stormwater Pollution Protection Plan (SWPPP) using the ND DEQ WQD’s template,

• ND DEQ WQD’s template Inspection Records included so the Contractor knows what information must be documented and submitted to NPS for compliance documentation, and

• Notice of Termination (NOT) with Project information filled out.

Should you have questions, please do not hesitate to contact me.

Respectfully, STANTEC CONSULTING SERVICES INC.
