Subject: Request for Proposal (RFP) # 959006-22-R-0004. Training Delivery Services for the John S. McCain III National Center for Collaboration in NEPA (National Environmental Policy Act) in Tucson, Arizona
This is a Request for Proposal (RFP) to provide non-personal training delivery services for the John S. McCain III National Center for Environmental Conflict Resolution’s (National Center)’s Collaboration in NEPA (National Environmental Policy Act) course. The National Center delivers trainings that are open to the public and professionals from all fields, as well as group trainings provided for requesting organizations. These trainings can be delivered in person or online. The training courses provide participants with essential negotiation and conflict management skills as well as opportunities to practice ECCR.
These trainings teach practical strategies to resolve a wide variety of contentious issues and emphasize collaborative problem-solving processes that create opportunities for dialogue, mutual understanding, and respect in environmental conflicts. This approach builds long-term relationships and produces enduring and creative results to settle even the most intractable problems. The resulting contract will provide for one base year with two
(2) additional option years available. The base period of performance for this effort is estimated to begin on 15 April 2022 through 14 April 2023, with a final option period of performance end date of 14 April 2025. The place of performance is the contractor’s facility with the possibility of travel to various training sites in either Tucson, Arizona or Washington D.C.
This will be a Full and Open (F&O) competitive Request for Proposal (RFP). The applicable NAICS code for this requirement is 541620, Environmental Consulting Services with a Small Business Size Standard of $16.5M. The Product Service Code is U008. All proposals shall be marked indicating that the validity for 60 calendar days from date of the RFP submission due date. The Government reserves the right to incorporate all or part of an Offeror's proposal into the resultant contract, such as the proposed technical approach will be incorporated into the contract as an attachment to the Performance Work Statement (PWS). Portions of an offeror's proposal that are incorporated into the resulting contract shall be deemed to have been drafted by the cognizant Offeror. The contract will provide for one deliverable and is identified in Section
5.0 of the attached PWS. The Contract Data Requirements List (CDRL(s)) provide the required format, content, and submission timeline for the deliverable and is attached to this RFP.
Any award to be made will be based on the best overall (i.e., best value) proposal that is determined to be the most beneficial to the Government, with appropriate consideration given to the three evaluation factors: Technical Approach, Past Performance, and Price.
Technical Approach is more important than Past Performance. Past Performance is more important than Price. Technical Approach and Past Performance, when combined, are more important than Price. Offerors are cautioned that any award may not necessarily be made to the lowest price offered and that to receive consideration for award, a rating of no less than “Acceptable” must be achieved for the technical approach evaluation factor. The Government intends to award without discussions.
PROPOSAL INSTRUCTIONS
Proposal instructions (Section L) are provided below:
1. Proposals shall be submitted in three separate volumes: Technical Approach, Past Performance, and Price. Each volume shall be numbered (e.g. 1 of 3). Information shall be confined to the appropriate volume to facilitate independent evaluation. Proposals shall be cross-indexed to applicable parts of the Performance Work Statement (with all proposal pages appropriately numbered). To reduce proposal size, Offerors shall submit only essential matters sufficient to clearly present their approach and provide an adequate basis for evaluation. All proprietary information shall be clearly marked.
To receive the highest possible rating, Offerors are advised to provide specific information that demonstrates how they will perform the tasks. No credit will be given a proposal which merely repeats, mimics, or “parrots back” the requirement and fails to describe an actual approach to conducting the work.
The proposal shall be submitted via e-mail to harrison@udall.gov. The titles for each file are shown in the table below.

The Microsoft Office Suite shall be used in submission of the proposal files. Security permissions on the “.xls” and “.doc” files shall be set to allow the Government to select, cut, paste and print text and graphics. Microsoft Word documents shall use:
Font – Times New Roman Size – 12 Margins – Left & Right .75 inch, Top & Bottom 1 inch.
Line spacing shall be no less than single space. Each paragraph shall be separated by at least one blank line. Footnotes to text shall not be used. If the Offeror submits annexes, appendices, attachments, or other documentation not specifically required by this solicitation, such will count mailto:harrison@udall.gov against the Offerors page limitations unless otherwise indicated in the specific Volume instructions below.
In addition, one complete copy of each volume shall be submitted in Adobe Acrobat “.pdf” format. **NOTE: Pages submitted beyond the limitations stated above, or which do not follow the criteria stated above will not be considered for evaluation. Pages submitted beyond the limitations stated above will not be considered for evaluation. Pages not evaluated due to violation of the margin, font, or spacing restrictions will not count against the page limitations.
All documentation submitted related to the Key Personnel requirement in the PWS shall be contained in the Technical Approach volume. **Note: No names of personnel shall be referenced in the proposal. Any resumes submitted for evaluation shall be redacted of all personal information, to include names.
A. The Government requires the following information to evaluate if your company has demonstrated understanding of the scope of this project and can meet the requirements.
B. Offerors are responsible for including sufficient details to permit a complete and accurate evaluation of each proposal.
a. Volume I - Technical Approach. The proposal for technical approach must demonstrate a clear understanding of the scope of this contract.
The basic process by which all tasks are to be conducted should be clearly addressed. This should include discussion regarding how the contractor will prepare for a specific task, what will occur once the contractor arrives on site (if appropriate), and the process by which the tasks shall be conducted in order to ensure that they are completed on schedule.
The proposal must demonstrate that the Offeror has a clear understanding of staff level, experience, and training required to perform the tasks, and demonstrate the Offeror’s plan to use the staff in the most effective and efficient way possible in support of this contract.
The proposal should provide discrete requirements identifying the technical credentials of all personnel to be assigned to this contract. Credentials shall include the extent (quantity of experience as well as skill) and level (sophistication of the experience and skill) of the experience and skills. Offerors should address why they believe their proposed labor categories are the most appropriate for the work to be performed in support of each task. Proposals should also address what plans or programs are in place to ensure the retention of key/skilled personnel with high technical proficiency in environmental collaboration and conflict resolution. All documentation submitted related to the Key Personnel requirement in the PWS, shall be contained in the appropriate volume. *Note: No names of personnel shall be referenced in the proposal. Any resumes submitted for evaluation shall be redacted of all personal information, to include names.
b. Volume II – Past Performance. Offerors shall submit a description of Government and/or industry contracts (prime and major subcontracts in performance during the past two years) which are relevant to the efforts required by this solicitation. Relevant is defined as having substantive NEPA experience and directly delivered training to participants covering essential related topics. In addition, the performance record should include topics detailed in Section
12.0 Contractor Qualifications of the PWS. The performance record must be relevant to the requirement in size and complexity and describe details pertaining to quality, schedule, cost control, personnel management, and business relations.
This volume shall be organized into the following sections:
(1) Section 1 - Contract Descriptions. This section shall include the following information (as applicable) in the following format:
a) Contractor/Subcontractor place of performance, CAGE Code and DUNS number.
b) Name and location of Government contracting activity.
c) Procuring Contracting Officer’s name and telephone number.
d) Contract Number.
e) Contract Type.
f) Awarded price/cost.
g) Final or projected final, price/cost.
h) Original delivery schedule.
i) Final or projected final, delivery schedule.
(2) Section 2 - Performance. Offerors shall provide a specific narrative explanation of each contract listed describing the objectives achieved and detailing how the effort is similar to the requirements of this solicitation. For any contracts which did not/do not meet original cost, schedule or technical performance requirements, provide a brief explanation of the reason(s) for the shortcomings and any corrective actions taken to avoid recurrence. Offerors shall list each time the delivery schedule was revised and provide an explanation of why the revision was necessary. The offeror shall also provide a copy of any cure notices or show cause notices received on each contracts listed and a description of any corrective action taken. Offerors shall indicate if any of the contracts listed were terminated and the type and reasons for the termination.
(3) Section 3 - Subcontracts. Offerors shall provide an outline of how the effort required by the solicitation will be assigned for performance within the contractor’s corporate entity and among the proposed subcontractors. Offerors shall provide the above required information for any proposed subcontractor whose subcontract is for more than 20% of the total proposed cost.
(4) Section 4 - New Corporate Entities (if applicable). New corporate entities, if applicable, may submit data on prior contracts involving its officers and employees. However, in addition to the other requirements in this section, the offeror shall discuss in detail the role performed by such persons in the prior contracts cited.
c. Volume III- Price. Offerors shall submit a price proposal using the attached Microsoft Excel file. Additionally, the proposal shall include the government provided travel values (included within the spreadsheet).
EVALUATION OF PROPOSAL
Evaluation criteria (Section M) are provided below:
(a) This requirement, when awarded, will follow, and incorporate the applicable FAR, and other applicable Federal, State, and Local Statutes, Codes, or Regulation.
(b) The Government intends to evaluate and award without discussions; however, if deemed necessary, notification will be provided electronically.
(c) The Government will award a firm fixed price contract, with a cost reimbursable CLIN for travel. The price proposal will be evaluated for fair and reasonableness.
(d) All proposals shall be subject to evaluation by a team of Government personnel.
1. Technical Evaluation Approach. The evaluation process will consider the following.
a. Understanding of the Task. Proposals will be evaluated to determine the extent to which the technical requirements have been considered, defined and satisfied and whether each requirement of the solicitation has been addressed in the proposal in accordance with the Proposal Submission section of the solicitation. Proposals will be evaluated to determine whether the Offeror’s methods and approach in meeting the requirements provide the Government with a high level of confidence of successful completion and if the approach taken is feasible and will result in the RFP requirements being fully met or exceeded. Proposals will be evaluated on the extent to which the proposal indicates that the Offeror clearly understands the delivery of training with the intent of providing essential substantive understanding of NEPA processes and context, including ability to share NEPA case examples based on work experience and any related best practices and lessons learned, knowledge of the benefits and challenges of collaboration within the NEPA process, and knowledge of environmental justice considerations in NEPA processes. In addition, proposals will be evaluated on the extent to which the approach demonstrates how the offeror intends to meet the desired Contractor expertise outlined in Section 12.0 of the PWS. Proposals will be evaluated on the extent to which a staffing plan addresses the specific requirements of this contract and indicates that the Offeror understands the technical expertise required of personnel assigned to the contract.
2. Past Performance Evaluation Approach. The Past Performance evaluation will assess the past performance information collected and determine the quality of the offeror's performance, general trends, and usefulness of the information.
a. The Government will conduct a past performance evaluation based on the quality, relevancy and recency of the Offeror’s past performance, as well as that of its major subcontractors, as it relates to the probability of successful accomplishment of the required effort. For purposes of this contract, experience is defined as recent if it was performed in the last two years. These requirements include all aspects of schedule and performance, including the Offeror’s record of: 1) substantive understanding of NEPA, ability to share NEPA case examples, understanding of opportunities for collaboration within different phases of the NEPA process and environmental justice considerations, and experience delivering training on relevant NEPA concepts and skills; 2) adherence to contract schedules, including the administrative aspects of training delivery; 3) commitment to customer satisfaction; and 4) business-like concern for the interest of its customers.
b. A significant achievement, problem, or lack of relevant data in any element of the work can become an important consideration in the evaluation process. A negative finding under any element may result in an overall limited or no confidence rating. Therefore, Offerors are reminded to include all relevant past efforts, including demonstrated corrective actions, in their proposal.
c. An Offeror with no relevant performance history will receive a neutral performance confidence rating having no positive or negative significance. An Offeror with such a neutral rating may, however, be considered less favorably than an Offeror with a favorable performance history. Conversely, an Offeror with a neutral rating may be considered more favorably than an Offeror with a poor performance history.
d. Offerors are cautioned that in conducting the past performance evaluation, the Government may use data provided in the Offeror’s proposal, and data obtained from other sources. Since the Government may not necessarily contact all sources provided by the Offerors, it is incumbent upon the Offeror to explain the relevance of the data provided. Offerors are reminded that while the Government may elect to consider data obtained from other sources, the burden of proving good past performance rests with the Offerors.
3. Price Evaluation Approach. The Government will evaluate offers for award purposes by adding the total of all CLIN/SLIN line items, including options. Price proposals will be compared to the Government Cost Estimate and competing proposals.

52.204-21 Basic Safeguarding of Covered Contractor Information Systems
BASIC SAFEGUARDING OF COVERED CONTRACTOR INFORMATION SYSTEMS (JUN 2016)
(a) Definitions. As used in this clause–
Covered contractor information system means an information system that is owned or operated by a contractor that processes, stores, or transmits Federal contract information.
Federal contract information means information, not intended for public release, that is provided by or generated for the Government under a contract to develop or deliver a product or service to the Government, but not including information provided by the Government to the public (such as on public websites) or simple transactional information, such as necessary to process payments.
Information means any communication or representation of knowledge such as facts, data, or opinions, in any medium or form, including textual, numerical, graphic, cartographic, narrative, or audiovisual (Committee on National Security Systems Instruction (CNSSI) 4009).
Information system means a discrete set of information resources organized for the collection, processing, maintenance, use, sharing, dissemination, or disposition of information (44 U.S.C. 3502).
Safeguarding means measures or controls that are prescribed to protect information systems.

(b) Safeguarding requirements and procedures.
(1) The Contractor shall apply the following basic safeguarding requirements and procedures to protect covered contractor information systems. Requirements and procedures for basic safeguarding of covered contractor information systems shall include, at a minimum, the following security controls:
(i) Limit information system access to authorized users, processes acting on behalf of authorized users, or devices (including other information systems).
(ii) Limit information system access to the types of transactions and functions that authorized users are permitted to execute.
(iii) Verify and control/limit connections to and use of external information systems.
(iv) Control information posted or processed on publicly accessible information systems.
(v) Identify information system users, processes acting on behalf of users, or devices.
(vi) Authenticate (or verify) the identities of those users, processes, or devices, as a prerequisite to allowing access to organizational information systems.
(vii) Sanitize or destroy information system media containing Federal Contract Information before disposal or release for reuse.
(viii) Limit physical access to organizational information systems, equipment, and the respective operating environments to authorized individuals.
(ix) Escort visitors and monitor visitor activity; maintain audit logs of physical access; and control and manage physical access devices.
(x) Monitor, control, and protect organizational communications (i.e., information transmitted or received by organizational information systems) at the external boundaries and key internal boundaries of the information systems.
(xi) Implement subnetworks for publicly accessible system components that are physically or logically separated from internal networks.
(xii) Identify, report, and correct information and information system flaws in a timely manner.
(xiii) Provide protection from malicious code at appropriate locations within organizational information systems.
(xiv) Update malicious code protection mechanisms when new releases are available.
(xv) Perform periodic scans of the information system and real-time scans of files from external sources as files are downloaded, opened, or executed.
(2) Other requirements. This clause does not relieve the Contractor of any other specific safeguarding requirements specified by Federal agencies and departments relating to covered contractor information systems generally or other Federal safeguarding requirements for controlled unclassified information (CUI) as established by Executive Order 13556.
(c) Subcontracts. The Contractor shall include the substance of this clause, including this paragraph (c), in subcontracts under this contract (including subcontracts for the acquisition of commercial items, other than commercially available off-the-shelf items), in which the subcontractor may have Federal contract information residing in or transiting through its information system.

52.204-22 Alternative Line Item Proposal
ALTERNATIVE LINE ITEM PROPOSAL (JAN 2017)
(a) The Government recognizes that the line items established in this solicitation may not conform to the Offeror’s practices. Failure to correct these issues can result in difficulties in acceptance of deliverables and processing payments. Therefore, the Offeror is invited to propose alternative line items for which bids, proposals, or quotes are requested in this solicitation to ensure that the resulting contract is economically and administratively advantageous to the Government and the Offeror.
(b) The Offeror may submit one or more additional proposals with alternative line items, provided that alternative line items are consistent with subpart 4.10 of the Federal Acquisition Regulation. However, acceptance of an alternative proposal is a unilateral decision made solely at the discretion of the Government. Offers that do not comply with the line items specified in this solicitation may be determined to be nonresponsive or unacceptable.

52.212-2 Evaluation – Commercial Items
EVALUATION-COMMERCIAL ITEMS (OCT 2014)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.
(e)
(1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1) in a subcontract for commercial items. Unless otherwise indicated below, the extent of the flow down shall be as required by the clause-
(i) 52.203-13, Contractor Code of Business Ethics and Conduct (JUN 2020) (41 U.S.C. 3509).
