PART 3 – EXECUTION

3.01 UV SYSTEM FIELD PERFORMANCE TESTING

A. After installation, operating equipment and systems will be operationally tested by the Supplier in the presence of the Engineer to demonstrate compliance with the specified requirements. Performance testing will be conducted by the Owner under the specified design operating conditions or under such simulated operating conditions as recommended or approved by the Engineer.

B. In the event of malfunction or failure to perform as specified, and it is determined by the Engineer that the equipment or system furnished under this Contract is in nonconformance with the Preselection Document, the Supplier of the equipment specified herein shall bear all costs for repair, replacement, re-testing, and other damages resulting from noncompliance with these Contract Documents.

3.02 CORRECTION, UTILIZATION OF DEFECTIVE WORK (UV SYSTEM)

A. Rejected Materials and Workmanship: In the event materials and equipment are delivered to the jobsite in a damaged condition, Supplier shall be contacted immediately and Owner shall give Supplier the first opportunity to inspect the damaged materials and equipment wherein Supplier shall participate with Owner in determining the best course of action to proceed thereunder to repair or replace some or all of the materials and equipment. The Engineer shall have the right to reject materials and workmanship that are defective, or to require their correction. Rejected workmanship shall be satisfactorily corrected and rejected materials shall be removed from the premises without charge to the Owner. If the Supplier does not respond with a plan for corrective action within 10 calendar days and correct such rejected work within 30 calendar days of written notice, the Owner may correct same and charge the expense to the Supplier or seek remedies to satisfy the Contract requirements.

B. Reinspection: Should it be considered necessary or advisable by the Engineer at any time before final acceptance of the entire work to make an examination of work already completed, by removing or disassembling any portion thereof, the Supplier shall on

Kellogg Creek WRRF UV Upgrades 00 70 00-2 March 2026 request promptly furnish all necessary facilities, labor, and materials. If such work is found to be defective in any respect due to the fault of the Supplier, it shall defray all the expenses of such examinations and satisfactory reconstruction. If, however, such work is found to meet the requirements of the Contract, the additional cost of labor and materials necessarily involved in such examination and placement shall be paid to the Supplier as provided elsewhere.

C. Utilization of Defective Work: Should the Engineer and Owner decide that the defective work can be utilized, they may elect to make an equitable deduction rather than require correction. If corrections are ordered, such corrections of defective work shall be made to the Engineer’s satisfaction before final payment is made, but final payment shall not be a waiver of the Owner’s right to demand correction of faulty workmanship or material which becomes apparent during the guarantee period stipulated in this Contract.
