About this file
This document is Attachment B: Performance Guarantees for Invitation to Negotiate (ITN) No. DMS-24/25-232, issued by the Florida Department of Management Services for Group Term Life Insurance. The attachment details a comprehensive set of performance standards and financial consequences for the selected contractor, covering six primary areas: Implementation, Account Management, Support Services, Customer Service, Data and Interface, and Reporting and Deliverables. Performance indicators include timely submission of implementation plans, holding weekly status meetings, establishing a state-specific website and phone line by August 1, 2025, maintaining quarterly performance reviews, staffing open enrollment benefit fairs, providing customer service with specific response time metrics, processing enrollment files, and managing plan materials.
The performance guarantees include specific financial penalties for non-compliance, ranging from $500 to $5,000 per occurrence or day of delay. Key performance metrics include 99% of medical underwriting determinations completed within 10 business days, 99% of written inquiries acknowledged within 21 calendar days, 100% of enrollment files loaded within two business days, and maintaining a 90% participant satisfaction rate. The document establishes a rigorous framework for measuring and ensuring the contractor's performance, with precise measurement methodologies and quarterly assessment intervals. Financial consequences are designed to incentivize timely, accurate, and high-quality service delivery across all aspects of the group term life insurance contract.

ATTACHMENT B: PERFORMANCE GUARANTEES
It is critical to the success of the State’s benefits plans that Services be maintained in a timely manner and that the Contr actor operates in a reliable manner. It would be impracticable and difficult to repair the actual damage sustained by the State in the event of c ertain delays or failures in scheduled Services and the provision of Services to Members served by this Contract. The Department and Contracto r, therefore, agree that in the event of certain delays and failures, the amount of damage that will be sustained will be the amount set forth in this
Attachment.
Further, Contractor agrees that in the event of any such failure of performance, Contractor shall pay such amount as financial consequences under section 287.058(1)(h), F.S., and not as a penalty. At its option, the Department may, for any amount due to the State as financial consequences, deduct such an amount from any money payable to Contractor or may bill Contractor as a separate item.
