About this file

This Data Use Agreement is between the State of Florida's Department of Management Services (Department) and a potential vendor for the Group Term Life Insurance Invitation to Negotiate (ITN) No. DMS-24/25-232. The document establishes strict protocols for accessing and handling a Revised Census File containing protected enrollee information, with the primary purpose of enabling potential vendors to prepare responses to the ITN. Key requirements include maintaining confidentiality, using password-protected systems, restricting access to authorized representatives, and permanently deleting all protected information after the ITN process concludes, whether or not the vendor submits a reply.

The agreement mandates comprehensive data protection measures, including compliance with HIPAA and other relevant regulations, prohibiting identification of individual enrollees, reporting any unauthorized access within three calendar days, and acknowledging the Department's right to seek injunctive relief for non-compliance. Vendor representatives must sign an access list, agreeing not to use or disclose the protected information for any purpose other than responding to the ITN. The agreement is governed by Florida law, with any disputes to be resolved in Leon County courts, and includes provisions for the vendor to destroy all protected information within specified timeframes following the ITN process.
