About this file
This is a certification form issued by the California Department of General Services (DGS) Procurement Division regarding compliance with the Darfur Contracting Act under Public Contract Code Sections 10475-10481. The form applies to any company that has conducted business activities or operations outside the United States within the previous three years and seeks to bid on or submit a proposal for a State of California contract. The document outlines two compliance pathways: Option 1 requires companies to certify under penalty of perjury that they are not a scrutinized company as defined in Public Contract Code Section 10476, while Option 2 permits scrutinized companies to submit bids or proposals if they have obtained written permission from the DGS Director on a case-by-case basis, provided such approval is in the best interests of the state. Companies without international business activities or operations during the previous three-year period are exempt from completing this certification form.
Both certification options require bidders to provide their company name, Federal ID Number, and authorization from an official with legal authority to bind the organization. The form necessitates a signature, printed name, title of the signing official, and date of certification. Bidders selecting Option 2 must include a copy of the written permission letter from DGS with their proposal submission. This certification requirement applies specifically to the SB1249 Consulting proposal opportunity, which seeks a contractor to provide Older Americans Act Area Agency on Aging designation process mapping, risk analysis mapping, and contract development services in compliance with the Older Americans Act and Senate Bill 1249.
