About this file
This is a VA Acquisition Regulation (VAAR) Class Deviation document establishing new contracting requirements for federal acquisitions by the Department of Veterans Affairs.
The deviation modifies VAAR Part 822 (Application of Labor Laws to Government Acquisitions) and Part 852 (Solicitation Provisions and Contract Clauses) to require contractor compliance with Executive Order 13899, Combating Anti-Semitism. Effective April 2025, contracting officers must insert clause 852.222-71 into all solicitations and contracts exceeding the simplified acquisition threshold. The clause requires contractors to comply with Executive Order 13899 pursuant to Title VI of the Civil Rights Act of 1964 and mandates timely written disclosure to the Contracting Officer whenever the contractor has credible evidence that a principal, employee, agent, or subcontractor has committed a violation under the executive order. Contractors must flow down these terms and conditions to all subcontracts and purchase orders. The baseline regulation text references 48 CFR Chapter 8 dated October 7, 2024.
