About this file

This is a Community Benefit Agreement Information Sheet issued by the City of Tampa, Florida, outlining mandatory requirements for developers undertaking projects that receive city participation. The document establishes a tiered framework applicable to the redevelopment of the Royal Street Parking Lot and Army/Navy Store Site in the Downtown Community Redevelopment Area. Projects are categorized into three tiers based on construction value and city participation amounts, with increasingly stringent requirements. Tier 1 applies to projects exceeding $5 million in construction cost with city participation of at least 20% or any project with city participation of $10 million or greater. Tier 2 mandates requirements for projects exceeding $10 million in construction cost with 20% city participation or $20 million in city participation. Tier 3 applies to projects exceeding $25 million in construction cost with 20% city participation or $30 million in city participation. The framework requires developers to hold two public meetings in the impacted community—one prior to drafting the Term Sheet and one before approval of the negotiated Community Benefit Agreement.

All tiers mandate compliance with existing city land development regulations, submission of a Construction Planning Worksheet, achievement of minimum Small Business Enterprise and Minority Business Enterprise (SBE/MBE) participation requirements ranging from 15% to 30% depending on tier level, and creation of a Community Impact Report addressing fiscal, housing, employment, utility, traffic, small business, environmental, social, health, and sustainability impacts. LEED certification requirements escalate by tier, with Tier 2 and Tier 3 projects requiring LEED Silver certification. Tier 1 and Tier 2 projects must include streetscape and public realm improvements aligned with community master plans. Tier 2 projects require selection of at least one additional community benefit from a prescribed list including affordable and workforce housing construction, historic building renovation, public parking, complete streets improvements, technological public improvements, sustainability and resiliency efforts, vacant structure demolition, and public space development. Tier 3 projects must provide items from both the Tier 2 list and select from additional options including responsible wage requirements with benefits and housing subsidies for employees earning under 100% of average state wage, with all Tier 3 items commensurate with the city's contribution.
