About this file
This document is an Executive Summary for a Phase I and Limited Phase II Environmental Site Assessment (ESA) conducted by NovelEsolutions, Inc. for the City of Tampa, focusing on a property located at 1312 North Tampa Street. The assessment was performed to evaluate the environmental conditions of the site in preparation for potential acquisition, with the goal of identifying recognized environmental conditions (RECs) and assessing potential contamination. The site reconnaissance was conducted on November 4, 2020, with soil and groundwater sampling completed on November 10, 2020, following the American Society for Testing and Materials (ASTM) Standard E1527-13.
The assessment revealed several historical environmental concerns, including a dry cleaner, auto repair shop, and sign painting facility that operated on the property between 1949 and 1969. The Limited Phase II ESA involved installing thirteen soil borings and collecting six soil and five groundwater samples. Key findings include low levels of carcinogenic polycyclic aromatic hydrocarbons (PAHs) in soil samples and a lead concentration of 302 micrograms per liter in a temporary groundwater monitoring well, which exceeded regulatory cleanup target levels. Additionally, the assessment included a non-scope survey identifying asbestos-containing materials in the 9" x 9" green vinyl flooring tiles and flooring mastic, though no lead-based paint was detected above regulatory limits. The report recommends further evaluation and potential consultation with an environmental attorney regarding the findings.

Dear Mr. Fernandez, NovelEsolutions, Inc. (NovelE) is pleased to provide this Executive Summary for Phase I and Limited Phase II Environmental Site Assessment (ESA) for due diligence at the above referenced. Our company offers a full range of turnkey environmental cleanup services utilizing innovative, but proven technologies, while maintaining a high level of client care.
Executive Summary
NovelE was retained by the City of Tampa to complete a Phase I ESA and a Limited Phase II ESA of a property located at 1312 North Tampa Street in Tampa, Florida. The City of Tampa is considering acquisition of the property. The purpose of the Phase I ESA is to identify recognized environmental conditions (RECs), as defined in American Society for Testing and Materials (ASTM) Standard E1527-13 (the Standard), at The Subject Property. The purpose of the Limited Phase II ESA is to obtain knowledge of the presence or absence of target parameters from previous discharges. This Phase I ESA was conducted to assist the City of Tampa in conducting all appropriate inquiries into previous ownership and use of The Subject Property to qualify for specific landowner liability protections under the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA) and to evaluate business environmental risk, as defined in the Standard, for The Subject Property. The Phase I ESA site reconnaissance was conducted by NovelE on November 4, 2020 and to expedite field activities for the Limited Phase II ESA, the soil and groundwater sampling at The Subject Property was conducted on November 10, 2020.
The following terms used in this report are defined in the Standard as follows:
o REC means the presence or likely presence of any hazardous substances or petroleum products in, on, or at a property due to any release to the environment or under conditions that pose a material threat of a release to the environment (de minimis conditions are not RECs).
1312 N. Tampa Street, Tampa, FL November 19, 2020 Executive Summary Phase I/Phase II ESA o Historical REC (HREC) is a past release of any hazardous substances or petroleum products that has occurred in connection with the property and has been addressed in a manner currently accepted by the applicable regulatory authority without subjecting the property to any activity and use limitations (HRECs are not RECs).
o Controlled REC (CREC) is a REC resulting from a past release of hazardous substances or petroleum products that has been addressed to the satisfaction of the applicable regulatory authority and that subjects the property to activity and use limitations.
o Business Environmental Risk (BER) means a risk which can have a material environmental or environmentally-driven impact on the business associated with the current or planned use of a parcel of commercial real estate, not necessarily limited to those environmental issues required to be investigated by the Standard.
The Subject Property consists of a polygonal shaped lot comprised of approximately 29,842 square feet of land for a total acreage of 0.685 acres. The Subject Property is currently occupied by a vacant retail building structure surrounded by unpaved areas. The retail store building covers an area of 8,200 square feet. The Subject Property was purchased by the current owner, 1312 N Tampa Street, LLC on August 31, 2017.
According to the owner’s property manager, Ms. Laura Neuwirth, the Subject Property has been owned by the Cohen family for over 40 years. A Site Vicinity Map is provided as Figure 1. A Site plan is provided as Figure 2. Figures are provided in Attachment 1.
Findings and Opinion
Based on the Phase I ESA including The Subject Property reconnaissance, database search, historical records reviewed, information provided by the owner representative, the following findings were identified regarding RECs, HRECs, CRECs, de minimis conditions, and select business environmental risk as defined in the Standard, at The Subject Property:
i) Historical use of the Subject Property: Three historical facilities of concern were identified on The
Subject property. One dry cleaner and one auto repair shop was operational on the south section of the property in 1949 and 1969, respectively. The Sign Painting facility was located on the west section of The Subject Property in the 1950 Sanborn Map. It is common knowledge that past environmental operations of drycleaners, auto repair and painting shops prior to 1970 were not stringent and potential discharges may have occurred during operations. Based on the lack of detailed information on past operations, these facilities are considered a REC at The Subject Property.
ii) Historical petroleum release of adjacent property: An historical petroleum release was reported at The City of Tampa Royal Street Parking Lot, property adjacent south to The Subject Property.
Ongoing investigation was conducted at the site. Based on the Supplemental Site Assessment report conducted by HSW Engineering Inc., dated July 8, 2020, the site met the No Further Action with Conditions, Risk Management Options Level II and recommended monitoring well abandonment. Based on the near closure of the site, the distant location of this release across E Fortune Street and further south related to The Subject Property, this facility is not considered a HREC to The Subject Property.
iii) Historical existence of several drycleaners and auto repair/stations in the vicinity of The Subject property: Several historical drycleaners and auto repair shops including gas stations were reported in the EDR database in the vicinity of The Subject Property from the years 1920 to 1980. The review of the Sanborn Maps and city directories confirmed the existence of these facilities and based on the site reconnaissance these facilities no longer exist, were located across the street and at a distance location related to The Subject Property. Therefore, these facilities are not considered a HREC to The Subject Property.
Conclusions NovelE has performed a Phase I Environmental Site Assessment in conformance with the scope and limitations of ASTM Standard E1527-13 of the Subject Property located at 1312 North Tampa Street in Tampa, Florida. Any exceptions to, or deletions from this practice are described in below:
o The owner representative has only had knowledge of The Subject Property for the past 7 years.
Recognized Environmental Conditions This assessment has revealed evidence of RECs at this Subject Property, as described above:
o Three historical facilities were identified on The Subject property. One dry cleaner and one auto repair shop was operational on the south section of the property in 1949 and 1969, respectively.
The Sign Painting facility was located on the west section of The Subject Property in the 1950 Sanborn Map. It is common knowledge that past environmental operations of drycleaners, auto repairing and painting shops prior to 1970 were not stringent and potential discharges may have occurred during operations. Based on the lack of detailed information of past operations, these facilities are considered a REC at The Subject Property.
Based on this conclusion, NovelE recommended performing a Limited Phase II ESA to address the HREC revealed during this Phase I ESA.
Historical Recognized Environmental Conditions This assessment has revealed evidence of the following historical HRECs at this Site, as described above:
o This assessment has revealed no evidence of HRECs at this Site.
Controlled Recognized Environmental Conditions This assessment has revealed evidence of the following controlled CRECs at this Site, as described above:
o This assessment has revealed no evidence of CRECs at this Site.
Business Environmental Risk This assessment has revealed evidence of the following historical BERs at this Site, as described above:
o This assessment has revealed no evidence of BERs at this Site.
The following data gaps/data failures were identified in this Phase I ESA:
o Requested FOIA Information: All requested FOIA information has not been received from the State or County environmental offices. Accordingly, the findings from additional information, if available, may have a material effect on the conclusions of this report.
o Historical Source Interval: Standard historical sources reviewed for this ESA were not available at the 5-year intervals described in Section 8.3.2.1 of the Standard. The historical aerial photographs and Sanborn maps were obtained from extended year intervals. Additional information sources were not considered reasonably ascertainable.
o No Key Site Manager with long-term knowledge of The Subject Property to Interview: As described in Section 10.5.1 of the Standard, the owner of The Subject Property is required to identify a key site manager to be interviewed by the environmental professional. The key site manager is supposed to be a person with "good knowledge" of the uses and physical characteristics of The Subject Property. The key site manager designated by The Subject Property owner was the property manager of The Subject Property and has seven years of experience of The Subject Property, however, Ms. Laura Neuwirth did not have knowledge of the long-term historical use at The Subject Property, which is considered to be data failure. Information from a key site manager with long term knowledge of The Subject Property could likely change the conclusions of this report.
The Limited Phase II ESA was performed on November 10, 2020. Pursuant to the Conceptual Site Model, NovelE supervised the installation of thirteen (13) soil borings and collection of six (6) soil samples and five
(5) groundwater samples. Soil and groundwater sampling were conducted in accordance with all applicable FDEP Standard Operating Procedures (SOPs), where applicable. Based on review of the data presented in this report, the following conclusions can be made regarding the Limited Phase II Assessment at the site:
o Target analytes were determined to be present at the site, which may be indicative of a release in one or more areas.
o OVA readings ranged from 0 to 6.3 parts per million (ppm) for the vadose zone screened soil samples.
o Soil samples collected from six (6) representative boring locations met the SCTLs as defined by Chapter 62-777, FAC for the analyzed constituents.
o Low levels of carcinogenic PAHs (i.e., benzo(a)anthracene, benzo(b)fluoranthene, benzo(k)fluoranthene, chrysene, dibenzo(a,h)anthracene, and indeno(1,2,3-cd)pyrene), benzo(a)pyrene, benzo(g,h,i)perylene, fluoranthene, pyrene, and TRPH were detected in one or more soil sampling locations. Carcinogenic PAHs were evaluated using the Benzo(a)pyrene Equivalents and met the SCTLs.
o Groundwater samples collected from five (5) representative locations met the Groundwater Cleanup Target Levels (GCTLs) as defined by Chapter 62-777, FAC for the analyzed constituents with the exception of lead.
o The lead concentration of 302 micrograms per liter (µg/l) detected in temporary well (TW-9) exceeded both the GCTL of 15 µg/l and the Natural Attenuation Default Concentration (NADC) of 150 µg/l. Turbidity readings in TW-9 were elevated and installation of a permanent monitoring well at this location may provide a more definitive evaluation of groundwater quality in this area.
o In the area of anticipated chlorinated solvents (i.e., area of former dry cleaner), groundwater sampling was proposed at depths of 15, 20, 25 and 35 ft bgs. Based on the site lithology at depth in the vicinity of the former dry cleaner (i.e., SB-5), the geoprobe rig was unable to push past a depth of 16 ft bgs. It should be noted that chlorinated solvents associated with dry cleaning operations are heavier than water and often sink to depths below 16 ft bgs.
NovelE has performed a Phase II ESA at the property at 1312 North Tampa Street in Tampa, Florida in conformance with the scope and limitations of ASTM Practice E 1903-19 and for the following objectives:
determine if former operations as a drycleaner, auto repair shop, and sign painting facility at the Subject Property have impacted soil or groundwater at concentrations above the State Cleanup Target Levels (CTLs). Based on the limited Phase II ESA soil and groundwater sampling, a lead concentration of 302 micrograms per liter (µg/l) from temporary monitoring well TW-9 exceeded both the GCTL of 15 µg/l and the NADC of 150 µg/l. Therefore, groundwater impacts were encountered from the REC identified at the Subject Property in the Phase I ESA. NovelE and its Phase II Assessor(s) assume no legal obligation for regulatory reporting of laboratory analytical results that may be indicative of a release at the Site. NovelE recommends the Client seek the advice of an Environmental Attorney prior to reporting of any discharges at the facility.
It is noted that a single round of sampling and chemical testing may not always provide data sufficient to meet the chosen objective. Based on the initial results, the user may wish to contemplate additional sampling in an iterative sequence, or the user may wish to redefine the objectives as stated in the report.
A copy of the tabulated data is provided in Attachment 2. A copy of the chain-of-custody and laboratory report is provided in Attachment 3.
To supplement the Phase I and Phase II ESA work conducted under the ASTM standards, Non-scope Considerations to include an asbestos and lead-based paint (LBP) survey were conducted on November 5, 2020.
o Based on the laboratory analysis results of the sampled suspected Asbestos Containing Materials (ACMs) by PLM, the following homogenous areas containing Asbestos above 1% were identified:
9” x 9” green vinyl flooring tiles and flooring mastic.
o Based on the results of the laboratory analysis for lead, none of the representative samples from suspect materials contained lead above the current Environmental Protection Agency (EPA) regulatory limit of 0.5% by weight.
A copy of the ACM and LBP surveys are included as Attachment 4 and Attachment 5, respectively.
This summary does not contain all the information that will be found in the full report. The report should be read in its entirety to obtain a more complete understanding of the information provided, and to aid in any decisions made, or actions taken, based on this information.
