About this file
This is a Mercury Affidavit attachment issued by the Maryland State Highway Administration (SHA) Office of Procurement and Contract Management (OPCM) for the On-Call Plumbing Repairs and Services solicitation at Hanover Complex. The affidavit serves as a compliance document requiring the authorized representative of a bidding business to certify under penalty of perjury whether products offered contain mercury. Bidders must indicate either that products contain no mercury or, if mercury is present, provide detailed descriptions of the affected product components and specify the exact amount of mercury contained, including the unit of measure. The affidavit must be submitted with all bid or proposal submissions and is effective as of July 2024.
The affidavit emphasizes that the document will be furnished to the procurement officer and may be distributed to State of Maryland units, counties and subdivisions, other states, and the federal government. Signatories acknowledge that the affidavit is subject to all applicable criminal and civil laws of the United States and Maryland, and that any misrepresentation or violation of obligations constitutes a breach of contract terms. This mercury disclosure requirement aligns with the green purchasing guidelines referenced in section 3.12 of the Invitation for Bid (IFB), supporting the state's environmental and sustainability objectives for the plumbing services and fixture replacement project.
