About this file
This justification document approves the use of brand name products and services for the United States International Development Finance Corporation Office of Information Technology's OIT Cloud First Enterprise Systems Support Services multiple-award IDIQ contract. The IDIQ will have a total value of $250 million over a five-year ordering period to provide resources across four pools in support of OIT operations, including infrastructure cybersecurity products from vendors such as Cisco, Microsoft, Palo Alto Networks, and Splunk. The justification cites Executive Order 14028 on improving cybersecurity and the need to integrate new capabilities with existing IT systems from approved brand name providers to meet security mandates while preventing disruption to critical activities.

Justification and Approval for Brand Name
1. Identification of the agency and contracting activity.
• Federal agency and contracting activity. U.S. International Development Finance Corporation (DFC)
• Sponsoring organization. Office of Information Technology (OIT)
2. Nature and/or description of the action being approved.
• Acquisition purpose and objectives. The purpose and objective of this acquisition is to obtain high quality information technology (IT) products, professionals, and technical services; to develop an industrial base of partners to help support DFC OIT operations; and to develop and continuously maintain an IT infrastructure and security posture that is strong, agile, and adaptable.
• Project background. As a newly created agency, the DFC is still growing and evolving to fulfill its increasing mission objectives and responsibilities under the Better Utilization of Investments Leading to Development (BUILD) Act. As the agency supports its current needs, while simultaneously collecting data to inform on future requirements, the agency requires an integrated yet responsive procurement strategy that can quickly support and adapt to the ever-changing geopolitical climate influencing the way it does business.
3. Description of the supplies or services required to meet the agency’s needs (including the estimated value).
• Project title. OIT CloudFirst Enterprise Systems Support Services (CFESSS).
• Project description. The OIT CFESSS is a suite of multiple award Indefinite-Delivery, Indefinite Quantity (IDIQ) contracts consisting of four pools that allow for task orders to be issued on a Fixed-Price (FP), Time and Materials (T&M), and/or Labor Hours (LH) basis. The four pools consist of Pool A—Operations, Pool B—Application Development, Pool C—Cyber Security, and Pool D—PMO Support Services. The scope of work under this IDIQ covers all DFC IT operations. This includes all required IT products and services, except where 1) The IT cannot be feasibly separated from the non-IT requirements or 2) when the IT is incidental to contract performance.
• Requirement type.

The OIT CFESSS will be a multiple-award IDIQ that allows for task orders to be issued on a Fixed-Price (FP), Time and Materials (T&M), and/or Labor Hours (LH) basis. The task orders may also combine more than one pricing arrangement (e.g FP/LH, etc.), although separate contract line-item numbers (CLINs) will be required for each pricing arrangement.
____ Other (specify): ___________

• Acquisition identification number. TBD
• Total estimated dollar value and performance/delivery period. The term of OIT CFESSS will be a five-year continuous ordering period, with the ability for orders to be placed with performance periods of up to five years throughout the ordering interval of the IDIQ. This means that work resulting from this IDIQ can span a ten-year performance period. This is not a multi-year contract as defined in Federal Acquisition Regulation (FAR) 17.103.
• Demonstration that the proposed contractor(s) unique qualifications or the nature of the acquisition requires use of the authority cited. This acquisition is conducted in part under the statutory authority of FAR 6.302-1, only one responsible source and no other supplies or services will satisfy agency requirements. This multiple-award IDIQ must be issued on a brand name basis to comply with Executive Order (EO) 14028, Improving the Nation’s Cybersecurity, and the Cybersecurity & Infrastructure Security Agency’s (CISA) policy mandates. In complying with these policy measures, the DFC is supporting our nation’s cybersecurity posture through the protection of our nation’s critical infrastructure and the Federal Government networks underlying our nation’s economy and way of life.

• Nature of the acquisition and proposed unique qualifications of the contractor(s). This is a brand name justification for other than full and open competition for particular services and highly specialized equipment needed to aid the agency in meeting specific cybersecurity and infrastructure requirements in an intelligent, flexible, and expedient fashion. As America’s development finance institution partnering with the private sector to finance solutions to the most critical challenges facing the developing world, it is still growing and evolving to meet its responsibilities under the BUILD Act. As a result, the OIT is tasked with the competing challenge of continuing to support agency operations without disruptions while expanding to meet new requirements to strengthen and protect the network infrastructure. Most products and services in place do not necessitate replacement for the sole purpose of competition, as such actions will result in substantial duplication of costs that would not be recovered through the competitive procedures. The goal is to integrate current services and products with the new without interrupting critical infrastructure processes and activities. Thus, the OIT must take into consideration the interoperability of new products and services that will be introduce into the IT landscape. As such, the brand name providers identified above have been selected because of their quality, their ability to work cohesively and interchangeably within the IT landscape, while meeting new infrastructure and security mandates.
4. Identification of the statutory authority permitting other than full and open competition.
X This acquisition is conducted under the authority of 41 United States Code (U.S.C.) 3304(A0(4) as set forth in FAR 6.302-1; Only one responsible source and no other supplies or services will satisfy agency requirements.
___ This acquisition is conducted under the authority of section 4202 of the Clinger-Cohen Act of 1996.
___ This acquisition is conducted under the authority of the Services Acquisition Reform Act of 2003 (41 U.S.C.
428a).
5. Description of the efforts made to ensure that offers are solicited from as many potential sources as practicable. Indicate whether a SAM.gov notice was or will be publicized as required by FAR Subpart 5.2 and, if not, which exception under FAR 5.202 applies. A SAM.gov notice will be publicized as required by the FAR.
See section 7 below to review additional efforts completed to engage industry in supporting this action.
6. Determination by the Contracting Officer that the anticipated cost/price to the Government will be fair and reasonable. The agency will evaluate the proposed ceiling hourly rates submitted by each offeror. A price analysis will be conducted in accordance with FAR 15.305(a)(1) and as described at FAR 15.404-1(b) to determine that the ceiling hourly rates proposed by the offeror are fair and reasonable.
7. Description of the market research conducted (see FAR Part 10) and the results, or a statement of the reasons market research was not conducted. In accordance with FAR Part 10, market research was conducted through a variety of methods to acquire greater perspective of the market and to engender a willingness for vendors to actively support and participate in this procurement initiative. Consequently, this office has issued a Request for Information (RFI), a Sources Sought Notice, and completed an Industry Day to get vendor buy-in and interest in supporting this endeavor. This office will also issue a draft Request for Proposal (RFP) to acquire additional information concerning market capabilities to further inform this action.
8. Any other facts supporting the use of other than full and open competition. There are no other facts to be presented in support of this justification.
9. Listing of sources, if any, that expressed, in writing, an interest in the acquisition.
10. Statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the required supplies or services. At the end of this multiple-award IDIQ lifecycle the OIT will reevaluate, and document mission needs against the IT landscape, assessing if other possible solutions can be introduced. All efforts will be made to continually assess if needs can be opened to competition and document when and why they cannot.
