About this file

This is a Conflict of Interest Affidavit required for submission with bids or proposals to the State of Maryland, specifically referencing COMAR 21.05.08.08 regulations. The affidavit applies to all offerors, contractors, consultants, subcontractors, and their employees or agents who have authority to control or supervise any portion of the contract work. Offerors must warrant that no relevant facts or circumstances exist that would create a conflict of interest, defined as situations where other activities or relationships impair objectivity, prevent impartial assistance to the State, or provide unfair competitive advantage. The document requires detailed disclosure of any actual or potential conflicts of interest in a designated section, with space for additional explanation if needed.

Offerors must submit the completed affidavit with their bid or proposal and are obligated to immediately disclose in writing to the procurement officer any conflicts of interest that arise after the affidavit date, including a description of actions taken or proposed to mitigate or neutralize such conflicts. The affidavit must be signed by an authorized representative under penalties of perjury, confirming the truthfulness and accuracy of all disclosed information. If a conflict is discovered after contract award and performance has commenced, the contractor shall continue performance until directed otherwise by the procurement officer.
