1.2 GENERAL BID NOTES

a. Award will be made on the total sum of Contract Line Items 0001AA, 0001AB and 0001AC.

For CLINs 0002 through 0007 enter unit prices or lump sum prices and extended totals in spaces provided. If there is a difference between a unit price or lump sum and the extended total, the unit price or lump sum price will be held to be the intended bid and the total recomputed accordingly. If an Offeror provides a total but fails to enter a unit price, the total divided by the specified quantity will be held to be the intended unit price.

b. Except when it is determined in accordance with FAR 17.206(b) not to be in the Government's best interest, the Government will evaluate offers for award purposes by adding the total price for the option(s) (CLINs 0002 through 0007) to the total price for CLIN 0001. In accordance with FAR 52.217-5 Evaluation of Options, evaluation of options will not obligate the Government to exercise the option(s).

c. The Government reserves the unilateral right to award CLIN(s) 0002 through 0007, to the

Contractor at the proposed price within sixty (60) calendar days after contract award.

d. The performance period for the work required by base price (CLIN 0001) shall be one thousand (1,000) calendar days from the date of award (this date includes 15 days for submission and approval of required bonds and insurance). If any or all option items are exercised, the contract completion date remains the same as that of the base price (CLIN 0001), as the work required by these options can be performed concurrent to the base work.

e. The Government may reject an offer as nonresponsive if it is materially unbalanced as to prices for the basic requirement and the options or additives quantities. An offer is unbalanced when it is based on prices significantly less than cost for some work and prices which are significantly overstated for other work.

f. For CLIN 0001AC, Unit price for all work in connection with the removal of geotechnically unsuitable soil (i.e. soft subgrade soils, pockets of organic materials, etc.) and replacement

DOCUMENT 00 22 13.00 20 Page 4 with imported structural fill or No. 57 crushed stone backfill. Unsuitable soil determinations shall be made by the Contracting Officer. The price shall include the removal of geotechnically unsuitable soils encountered at the base of planned foundation or utility excavations or identified during proofrolling of planned subgrades and backfilling the excavation with compacted imported structural fill (general site) or No. 57 crushed stone backfill (foundations and utility trenches). Imported structural fill shall conform to project specification requirements for Select Material (Section 31 23 00.00 20). Work excludes excavation and backfill already identified in the project plans. Soil disturbed by the Contractor's construction activities, or that are excessively wet or soft due to lack of proper site maintenance and lack of specified site drainage or excavation dewatering will not be considered unsuitable. Unit price shall include handling and transportation. The volume of material removed and imported backfill required shall be determined based on field measurements (length x width x depth) of the completed excavation to remove the unsuitable soil as approved by the Contracting Officer.

Work shall not proceed without prior written approval by the Contracting Officer.

g. If CLIN 0002 through 0007 are exercised, additional bonding and consent of surety is required. Consequently, the Performance Bond must reflect 100 percent of the aggregate amount of all Items.
