About this file

This is a Certification for a Drug-Free Workplace form (HUD-50070) issued by the U.S. Department of Housing and Urban Development (HUD) for applicants receiving federal grant funding. The form requires applicants to certify their commitment to maintaining drug-free workplaces by publishing statements prohibiting controlled substance use, establishing ongoing drug-free awareness programs, and requiring all employees engaged in grant performance to receive copies of the prohibition statement. Applicants must notify employees that they must abide by the terms of the statement and report any drug-related convictions to their employer within five calendar days of conviction. The form requires applicants to list all sites where work will be performed in connection with HUD funding, including street address, city, county, state, and zip code on separate attachment pages.

The form obligates applicants to notify the agency in writing within ten calendar days of receiving notice of an employee's drug conviction and to take appropriate personnel action, up to and including termination consistent with the Rehabilitation Act of 1973, or require the employee to participate in an approved drug abuse assistance or rehabilitation program within 30 calendar days of receiving notice. Employers must provide notice to every grant officer or designee whose grant activity involved the convicted employee, including the identification number(s) of each affected grant. The applicant's authorized official must sign and date the certification, attesting that all information provided is true and accurate, with warning that HUD will prosecute false claims and statements under 18 U.S.C. §1001, 1010, 1012 and 31 U.S.C. §3729, 3802.
