About this file

This document is an Equal Benefits Ordinance (EBO) disclosure and compliance certification form for the City of Long Beach, California. It outlines the requirements and procedures that contractors and vendors must follow when awarded contracts with the city.

The EBO applies to for-profit employers holding City contracts valued at $100,000 or more for the purchase of goods, services, public works, improvements, or construction projects, as well as for-profit entities generating $350,000 or more in annual gross receipts while leasing City property under written agreements exceeding 29 days in any calendar year. Subject contractors must certify compliance with the ordinance before contract execution by completing the provided EBO Certification Form or obtain a waiver from the City. The ordinance requires contractors to provide equal benefits to employees with spouses and employees with domestic partners, including health benefits, bereavement leave, family medical leave, membership discounts, moving expenses, retirement benefits, and travel benefits. Contractors may use cash equivalent payments if they have made all reasonable efforts to provide domestic partner benefits but are unable to do so.

Contractors may delay implementation of EBO compliance procedures under three circumstances: by the first effective date after the first open enrollment process following contract start (not exceeding two years) if submitting evidence of reasonable compliance measures; within three months to incorporate nondiscrimination procedures into infrastructure; or upon expiration of current collective bargaining agreements. Failure to comply with the EBO after the delay period expires constitutes material breach, subjecting the contractor to contract cancellation or suspension, disqualification from City contracting for three years, assessment of liquidated damages deductible from payments due, and pursuit of other available legal or equitable remedies. The City retains the right to access contractor records to verify EBO compliance.
