About this file

This document is a Debarment, Suspension, Ineligibility and Voluntary Exclusion Certification form required by the City of Long Beach for vendors seeking to receive federal grant funds through municipal contracts or purchase orders. The certification applies to all current and potential vendors doing business with the City and their associated principals, including owners, directors, partners, officers, managers, and individuals with substantial influence over covered transactions. No specific products, services, quantities, response dates, site visits, or bidder meetings are detailed in this certification form, as it serves as a compliance requirement rather than a solicitation document.

The certification requires vendors to attest under penalty of perjury that neither their business entity nor any principals are currently debarred, suspended, ineligible, or voluntarily excluded from federal assistance; have not been suspended, debarred, or excluded within the preceding three years; do not have a proposed debarment proceeding pending; have not been indicted, convicted, or had civil judgments rendered against them for fraud or misconduct within three years; and have not had public transactions terminated for cause or default within three years. The City of Long Beach verifies vendor compliance by checking the System for Award Management at www.sam.gov. Vendors must disclose any exceptions to the certification with explanatory attachments and notify the City within 21 days of any organizational changes or changes in principals' status. The Purchasing Division in the City of Long Beach Business Relations Bureau can be contacted at 562-570-6200 for questions regarding form completion. Providing false information may result in criminal prosecution or administrative sanctions.

Have not, within a three (3) year period preceding this bid/agreement/proposal, been suspended, debarred, voluntarily excluded or declared ineligible by a federal agency;

Do not presently have a proposed debarment proceeding pending;

Have not, within a three (3) year period preceding this bid/agreement/proposal, been indicted or convicted, or had a civil judgment rendered against it by a court of competent jurisdiction in any matter involving fraud or official misconduct;

Have not, within a three (3) year period preceding this bid/agreement/proposal, had one or more public transactions (Federal, State, or local) terminated for cause or default.

Acceptance of Certification

1. This bid/agreement/proposal or like document has the potential to be a recipient of Federal funds.

In order to be in compliance with Code of Federal Regulations, the City requires this completed form. By signing and submitting this document, the prospective bidder/proposer is providing the certification and acknowledgement as follows:

2. The terms “covered transaction,” “debarred,” “suspended,” “ineligible,” “lower tier covered transaction,” “participant,” “person,” “primary covered transaction,” “principal,” “proposal,” and “voluntarily excluded,” as used in this clause, have the meanings set out in the Definitions and Coverage sections of rules implementing Executive Order 12549.

3. The certification in this clause is a material representation of fact upon which reliance was placed when this transaction was entered into. If it is later determined that the prospective recipient of Federal assistance funds knowingly rendered an erroneous certification, in addition to other remedies available to the Federal Government, the department or agency with which this transaction originated may pursue available remedies, including suspension and/or debarment.

4. The potential recipient of Federal assistance funds agrees by submitting this bid/agreement/proposal or like document that, should the proposed covered transaction be entered into, it shall not knowingly enter into any lower tier covered transaction with a person who is debarred, suspended, declared ineligible, or voluntarily excluded from participation in this covered transaction, unless authorized by the department or agency with which this transaction originated.
