About this file

This is an Equal Benefits Ordinance Disclosure Form and Certification of Compliance document issued by the City of Long Beach pertaining to contractor and vendor requirements for City contracts. The document establishes nondiscrimination requirements for employee benefits as a condition of contract award. The Equal Benefits Ordinance (EBO), codified in Long Beach Municipal Code section 2.73 et seq., requires selected contractors to provide equal benefits to employees with spouses and employees with domestic partners during contract performance. Covered benefits include health insurance, bereavement leave, family medical leave, membership discounts, moving expenses, retirement benefits, and travel benefits. The EBO applies to for-profit employers holding City contracts valued at $100,000 or more for goods, services, public works, or construction projects, and to for-profit entities generating $350,000 or more in annual gross receipts from leasing City property under agreements exceeding 29 days in any calendar year.

Contractors subject to the EBO must certify compliance before contract execution by completing the certification form and submitting the EBO Certification Form, waiver, or evidence of compliance. The ordinance provides implementation flexibility allowing contractors to delay compliance procedures under three circumstances: by the first effective date after the first open enrollment following contract start (not exceeding two years) if reasonable measures to comply are demonstrated; within three months to incorporate nondiscrimination in benefits infrastructure; or upon expiration of current collective bargaining agreements. Material breach of EBO compliance can result in contract cancellation, termination, or suspension; designation as an irresponsible bidder with three-year disqualification from City contracting; assessment of liquidated damages; and pursuit of additional legal remedies. The certification form requires contractor information including name, Federal Tax ID, address, contact details, and responses to compliance questions regarding employee benefits availability for spouses and domestic partners.
