About this file
This document is an Auction Services Agreement between the City of Palo Alto and an unnamed auction company for the sale of city-owned surplus personal property, including earthmoving equipment, heavy duty trucks, lift equipment, generator sets, air compressors, asphalt pavers, and trailers. The agreement allows for both live and Internet-only auctions to be conducted within 30 days of property pickup or inspection, with a contract term of three years from the date of execution. The auction services will cover approximately 550 vehicles and equipment items, with auctions to be held at the auction company's facility or with items remaining at the city's location for Internet-only sales.
The auction company will receive a 7.5% commission on gross auction proceeds, with additional listing fees ranging from $75 to $500 depending on equipment type and location. The agreement requires the auction company to provide comprehensive services including inspection, marketing, advertising, and detailed sales reporting. Insurance requirements are stringent, with the auction company needing to maintain commercial general liability, automobile liability, property, and workers' compensation insurance with specific coverage amounts. The city reserves the right to select multiple auctioneers based on their expertise, and the contract includes provisions for advertising, bidder participation, and sales conditions, with all items to be sold "AS IS, WHERE IS" without warranties.
