About this file

This document is an affidavit attachment for the Commonwealth of Kentucky's HCM ERP System Replacement - Phase 1 request for proposals (RFP 758 2700000012). The file contains three required affidavits that bidders, offerors, and contractors must complete and have notarized prior to contract award or renewal. The first affidavit requires an authorized representative to attest under penalty of perjury that the contractor has not knowingly violated Kentucky campaign finance laws and that contract award will not violate any campaign finance provisions. The second affidavit pertains to resident bidder status and requires attestation that the bidding entity, on the date the contract is first advertised, is authorized to transact business in Kentucky and has maintained Kentucky corporate income tax filings, unemployment insurance fund payments, and workers' compensation insurance for one year prior to and through the advertisement date. The third affidavit addresses qualified bidder status, requiring bidders and all subcontractors to meet the qualifications under 200 KAR 5:410(3) and maintain compliance throughout the contract term, with specific provisions for nonprofit corporations furthering KRS Chapter 163 purposes or qualified nonprofit agencies for individuals with severe disabilities that employ individuals with severe disabilities for at least seventy-five percent of direct labor man hours.

The Commonwealth reserves the right to request documentation supporting any bidder's claim of resident or qualified bidder status at any time, and failure to provide requested documentation upon demand results in bidder disqualification or contract termination. All affidavits are valid for one year from the date of execution and must be subscribed and sworn before a notary public. These attestations are mandatory compliance requirements under KRS 45A.110 and 45A.115 for all entities seeking to be awarded contracts or pursue contract renewals with the Commonwealth of Kentucky.
