Section L - Instructions, Conditions, and Notices to Offerors

DEFINITIONS

As used in this solicitation/contract, the term "Government" shall refer to the "United States Government" unless express reference to a different named government is made. In addition, the words " Federal, States and Municipal" in the clause FAR 52.236-7, Permits and Responsibilities, are hereby modified to read "host government and its political subdivisions".

1. BID DELIVERY INSTRUCTIONS

1.1. This requirement will be procured using FAR 14 and FAR 36, Sealed Bidding and Construction Contracts. Offerors must follow the instructions contained herein. Offerors are cautioned that noncompliance with any of the terms and conditions of the Invitation for Bids (IFB) may result in their bid being deemed ineligible for consideration or award. Offerors shall submit only one bid, and the Government will review only one bid per offeror. Bids must be received no later than the date and time specified in Block 13 of the IFB. Bids delivered after the exact date and time for receipt of bids will not be considered. BIDDERS WILL BE

EVALUATED WITHOUT DISCUSSIONS.

1.2. A. Bids must be hand delivered in CD form with .pdf format files to the address in Block 7 of the SF 1442. Only electronic copies of the proposal will be accepted. It is the offerors responsibility to ensure that the bid reaches the office designated for receipt of bids within the time established in the solicitation.

2. VOLUME INSTRUCTIONS

2.1 General. Prospective bidders SHALL organize bids in the following volumes:

2.1.1 Proposals shall be in the English language.

2.1.2 Volumes (i.e. files) shall be separated and easily identified (ex. Volumes I, II & III).

2.1.3. The Government is not responsible for any costs incurred or associated with preparation and submission of a bid in response to this solicitation. NO OFFEROR WILL BE

COMPENSATED FOR SUBMITTING A BID.

2.2 Volume I – Completed SF 1442 (RFP)

The offeror shall submit the SF 1442 with all required fill ins. Complete Blocks #14, #15, #16 (if different than Block #14), #17, #20a,#20b,#20c, and Block #19, if amendments have been issued. An authorized official of the firm must sign Block 20b of the SF 1442. Complete pricing information on all Contract Line Items (CLINs) under Section B. Complete all appropriate and applicable Representations and Certifications. An individual with authority to contractually bind your company must sign the Standard Form 1442 in accordance with FAR 4.102.

2.3 Volume II – Certifications and Key Subcontractor Agreements: The Offeror shall complete ALL the necessary fill-ins and representations in their entirety and submit required certifications. Submit Certificate of Classification required by Spanish Law 9/2017, Law of Public Sector Contracts, (as stated in attachment 2 of the SF 1442) to demonstrate adequate financial resources, have a satisfactory integrity and business ethics record, have the necessary experience and technical skills and have the necessary construction and technical equipment. The submitted classification certificates must be original or a notarized copy and must be current.

The Offeror shall submit Memorandum of Agreement between the Bidder and each Subcontractor, if any, establishing that the key subcontractor shall perform the work activity indicated on that Memorandum of Agreement if the contract is awarded to the Bidder. The Memorandum of Agreement must be signed by the Bidder and the key subcontractor and shall be original or notarized copy.

2.4 Volume III – Construction Cost Breakdown: The Offeror shall complete the Construction Cost Estimate Breakdown form in its entirety.

3. BID OPENING

The bid opening will be conducted at the 496th Contracting Flight’s Conference Room, located at Building 106, Room 14, Moron AB, Spain. The bid opening date and time will match the date and time listed on the IFB. This is a public event, and anyone is allowed to attend. The Contracting Officer MUST have all bids by this date/time. Late bids will NOT be accepted.

HAND-CARRIED PROPOSALS NOTICE: Offerors are cautioned that Moron Air Base has stringent visitor control procedures requiring individuals not affiliated with the installation to obtain a visitor pass and be cleared by the Government point of contact prior to entrance. Please contact the POC's listed at least 3 business days prior to the Solicitation closing date to coordinate delivery of hand carried proposals. All Third Country Nationals must notify the POC's at least 14 business days prior to the solicitation closing date, as they must be approved through ODC Madrid prior to requesting base access.

4. SITE VISIT

A site visit will be held for this requirement. Please see the Site Visit Instructions within the solicitation package.

5. DISCREPANCIES AND AMBIGUITIES

If an offeror believes the requirements in these instructions contain an error, omission, ambiguities, or are otherwise unsound, the offeror shall immediately notify the Contract Specialist in writing with supporting rationale no later than seven (7) calendar days after the IFB release date.
