1.0 ON RAMPING:
The Government, at its sole discretion, may choose to on-ramp any number of contractors on the multiple award contract (MAC) Indefinite delivery indefinite quantity (IDIQ) contract at any time during the Space Test Experiments Platform 2.0 (STEP 2.0) Contract performance ordering period.
These procedures will be enforced to ensure an adequate number of awardees are available to provide competition needed to provide Space Test Program (STP) with rapid access to space for science and technology payloads on space vehicles, or when the Contracting Officer (CO) determines it to be in the best interest of the government.
Contractors are hereby notified utilization of any on-ramping procedures described herein shall not obligate the Government to on-ramp any new capability. The Government reserves the right to award more or no additional contracts if determined to be in the best interest of the Government. Previously unsuccessful offerors or off-ramped contractors will not be excluded from on-ramp opportunities.
The Government may on-ramp utilizing the following method:
1.1 Method 1 – Open On-Ramping
a) The Government will determine if it's within its best interest to initiate an open request to add additional spacecraft to the STEP 2.0 capability pool.
Any open on-ramping request for proposals will be posted to the Government Point of Entry, SAM.gov. Offers received will be evaluated against the same criteria used to establish the original pool of IDIQ contract holders.
b) When utilizing this method to on-ramp additional spacecraft, existing contract holders are not expected to respond to retain their contract. Only offers for new spacecraft will be entertained.
c) Successful offerors will either be awarded a STEP 2.0 IDIQ contract, or if they already hold an IDIQ contract and are on-ramping a new spacecraft, will be awarded a modification to incorporate the new capability. For each new spacecraft on-ramped, the contractor will receive a delivery order to meet the minimum order requirement called for by the basic contract’s term and conditions.
d) Within 30 days of award, the Government will notify all existing IDIQ contract holders of new on- ramped spacecraft.
e) The newly on-ramped contractors will immediately be able to compete for orders as of the effective date of the awarded IDIQ contract or modification.
The overall contract ceiling will remain unchanged and contract length will not be extended for newly on-ramped contractors.
2.0 OFF-RAMPING
While it is the Government's intent to maintain a strategic relationship with IDIQ contractors for the duration of the STEP 2.0 MAC IDIQ Contract, the Government reserves the unilateral right to off-ramp spacecraft from an IDIQ contract or otherwise revise the ordering period of the IDIQ contract to effectively off-ramp a contractor entirely via unilateral modification if deemed by the Contracting Officer to be in the Government’s best interest. Off-ramping will only be imposed after careful consideration of the situation and collaboration with the Contractor to resolve identified concerns.
The process to be used for off-ramping is as follows:
a) The Contracting Officer will send a letter to the contractor identifying a concern with a request for a remediation plan and timeline to address the problem.
b) If after consultation with the program office the Contracting Officer is satisfied with the remediation plan, the contractor will be notified of the plan’s acceptability and a re-evaluation period established to assess if the remediation plan was effective in addressing the identified concern.
c) If the Contracting Officer is not satisfied with the response, or the remediation plan is subsequently evaluated to be ineffective, the Contracting Officer will issue a Notice of Impending Removal to the contractor with the rationale underlying the decision and anticipated date of unilateral modification issuance.
d) The Contracting Officer’s decision may be appealed to the Ombudsman under Alternative Disputes Resolution (ADR), as defined in FAR Subpart 33.201.
