About this file
This letter outlines project submission requirements and procedures for the United States Section of the Construction Mixed Commission for fiscal year 2021 projects. Key details include:
-
Chapter I projects are for new construction works exclusively funded by the U.S. including new facilities, facility additions/alterations, demolitions, replacements, and temporary facilities requiring permanent construction elements. Chapter II projects only require review by the Italian Section and do not change facility cubic capacity, shape, use, or significantly alter external appearance.
-
Project Illustrative Statements are due by September 30 each year and should include the project title, purpose, requirements, type of construction, estimated costs, environmental statement, and endorsement from the Italian Base Commander. Supporting drawings include location plans, installation layouts, facility plans/elevations/sections, and utility/road plans.
-
Out-of-cycle submissions are due by March 31 and will only be considered for emergency or contingency operational requirements. Projects supporting new missions or personnel changes must be validated by Service Component leadership and legal staff and potentially coordinated with the U.S. Embassy in Rome.
-
Jointly funded or used projects shall not be submitted for CMC consideration and will be adjudicated separately. The enclosed CMC Technical Handbook outlines host nation design and construction legislation procedures.

1. Under reference (a), the USCMC Chair shared with the ISCMC Chair, the Chapter I and Chapter II projects' classification criteria and documentation requirements below, which reflect most of the new requirements that have arisen over the years since the implementation of reference (b). Effective immediately, please use the classification criteria and projects documentation below, upon submitting construction requirements to the CMC for review:
a. Chapter I-New Construction Projects to include:
(1) U.S. exclusively funded construction works required to erect, install or assemble a new facility, or add to, alter, expand, convert (change the use of), demolish or replace an existing facility;
(2) U.S. exclusively pre-financed construction work, as listed at sub-item 1 above, potentially eligible for NATO reimbursement. The CMC involvement with these projects entails just the review of the construction requirements. The submission of the Notice of Intent to Pre-finance to NATO, as well as all the procedures for submitting the documentation to the cognizant NATO authority to pursue reimbursement of the construction costs initially borne by the U.S., do not pertain to the CMC Area of Responsibility. These are referred to as Chapter III projects in reference (b).
Subj: FY21 PROJECT SUBMISSION REQUIREMENTS
(3) Temporary facilities which require elements of permanent construction;
(4) Roads and Utility Systems, e.g. new utility infrastructure work or significant upgrades to existing infrastructure where work affects the whole base. Changes to a particular section or an individual component of a road or utility system would not be considered a Chapter I project;
(5) Permanent Installation of Broadcasting Communication Systems, to include but not limited to Satellite Dishes, Microwave Dishes, LF, VHF, UHF, SHF, EHF, AEHF antennae, etc;
(6) PV Panels and Solar Thermal Panels when installed at Airport areas, as well as any other construction project subject to Airport Clear Zones Building Limitations;
(7) Projects which require review by the COMIPAR;
(8) Projects subject to Landscape Building Regulations which require review by an SBA/Regional Authority;
(9) Projects subject to Environmental Building Regulations which require review by a Park Agency/Regional Authority;
(10) Projects subject to Hydro-geological Building Regulations which require review by a Basin Authority/Town Hall Authority;
(11) Projects which require review by and coordination with a Town Hall or other local agencies.
b. Chapter II- Projects requiring review only by the ISCMC
(1) Projects which do not change the cubic capacity, or the shape of a facility;
(2) Projects which do not change the use of a facility;
(3) Projects which do not significantly change the external appearance of a facility but only result in minor alterations to it, e.g., the opening and installation of a new window or door in an existing wall, etc.;
(4) Projects which create a mezzanine, or an intermediate floor in a building which is partly open to the floor below, but which does not extend over the whole floor-space of the building. In these cases the operations performed in the mezzanine will stay the same as those performed in the existing facility.1
If a new mezzanine is intended to enable activities different than those performed in the existing facility, then the project is to be classified as Chapter I, because of the change of use.
below:
(5) Insta11ation1repair of technological systems, to include but not limited to the list
(a) Voice/Data lines;
(b) Boilers (inside existing facilities);
(c) Electrical systems;
(d) Mechanical systems;
(e) Hydraulic systems;
(f) Fire protection system;
(g) Energy saving systems.
(6) In addition to the above, the project must not require review by the COMIPAR, or be subject to review under Landscape Building Limitations, Environmental Building Limitations, Airport Clear Zones Building Limitations, Hydro-Geological Building Limitations, or any other governmental review that would be applicable to construction if carried out by the Italian military. If a project requires one of the foregoing reviews, it is to be classified as a Chapter I Project.

2. Please note that by reference (a), the project submission deadlines below have been established:
a. All annual PIS's, complete with drawings and the IBC comments page, should be submitted to the US Section Chair no later than 30 September annually. The US Section of the CMC will submit to the Italian Section of the CMC no later than the first week of October.
b. Out-of-cycle submissions that were unknown at the time of the annual submission deadline are to be submitted by 31 March of the following year.
c. Projects should rarely be submitted after 31 March, and will only be considered to the extent that they support emergent, emergency and/or contingency operational requirements.
3. Per reference (c), when submitting projects supporting a new operational mission, representing changes in the personnel loading of an installation, or executed at sites/facilities on land where the U.S. Government does not have designated, complete Operational Control (OPCON)/Exclusive Use, the following procedures will be followed:
a. Vet each project with your Service Component leadership (as defined by your chain of command) and installation legal staff2, and subsequently with the U.S. Embassy in Rome, if required, to make sure that you are submitting a validated requirement.
b. If a project is related to an increase of U.S. Forces, make sure that your respective components have coordinated the notification requirement through the U.S. Embassy. There are myriad situations where the notification process may take different forms or not be required, but I need your Components to ensure that due diligence has been performed.
c. Submit for each project, a letter certifying that it has been reviewed by installation counsel and that it complies with U.S. OPCON and applicable Technical Arrangement (TA)/Intemational Agreement criteria.
The Installation Commanding Officer/Commander shall work with their IBC counterpart to amend their installation's TA, reflecting changes in the ownership of facilities/land under consideration so as to establish U.S. OPCON/Exclusive Use. Please note that amendments to the TA exhibits are not common. You should not expect to see this often. However, if required, this is a necessary action in order to use U.S. funds for facility investment.
4. Please note that projects intended for joint funding or joint use, shall not be submitted to the USCMC for consideration. These construction requirements shall be adjudicated in a different forum.
5. The CMC Technical Handbook is forwarded as enclosure (1) and serves as a reference document to some of the key Italian Design and Construction technical legislation that is commonly encountered during the initiation and execution of CMC projects. The document
2 Or Service Component legal staff, when there is no legal staff assigned to an installation.
