About this file

This is a Darfur Contracting Act Certification form issued by the California Department of General Services for use in state contracting. The document applies to companies that have conducted business activities or operations outside the United States within the previous three years and wish to bid on State of California contracts. The form provides two certification options: companies may certify that they are not a scrutinized company as defined under Public Contract Code Section 10476, or they may provide written permission from the Department of General Services authorizing them to submit a proposal as a scrutinized company. Companies without international business activities in the previous three years are exempt from completing this certification.

The certification requires an authorized company representative to sign under penalty of perjury, providing the company name, Federal ID Number, and signature with printed name and title. For companies obtaining written permission from the Department of General Services under Public Contract Code Section 10477(b), a copy of the permission letter must be included with the bid or proposal submission. This form is mandatory for eligible bidders seeking contracts with state agencies and serves as a compliance requirement under California's Darfur Contracting Act provisions.
