5.1 The following criteria will be used to judge compliance with contract specifications:
FULL COMPLIANCE:
Performance is at the satisfactory level with a minimum number of complaints. All function services meet or exceed the contract specification level. The contractor's supervision, quality control program, and work inspection procedures are thorough, and he always moves to meet special requirements or problems. FAA inspections seldom find deficiencies.
MARGINAL COMPLIANCE:
The general level of service performance is below specification level. Occasional major problems are present, but not repetitive or continuous. Numerous complaints are experienced. The contractor's corrective response is not always prompt or effective. Continued performance at this level would jeopardize exercising an option year for renewal of services. FAA inspections continuously find deficiencies.
UNACCEPTABLE COMPLIANCE:
Performance is unsatisfactory and requires immediate and positive action by the contractor to improve service performance in order to continue the contract. Performance level is extremely low in some aspects of operations. Major and continuous problems go uncorrected or are corrected and immediately re-occur. Contractor fails to maintain a competent staff in the required number, or fails to control his employees. Contractor is unwilling or unable to cooperate with FAA staff in solving operational problems. The CO will issue a written notice to the contractor outlining corrective action and deadline schedule. FAA inspections fund numerous and repeated deficiencies.
5.2 Payment - The contractor shall submit monthly invoices, on an arrears basis. Each month the COR will review the contractor's performance in accordance with the above and the contractor's invoice will be processed in accordance with the following schedule:
FULL COMPLIANCE - 100% Payment (less identifiable, uncompleted, unacceptable work).
MARGINAL COMPLIANCE - Deductions will be made for all unacceptable or unaccomplished work.
UNACCEPTABLE COMPLIANCE - Deductions will be made for all unacceptable or unaccomplished work. Action will be initiated to terminate contract for default.
5.2.1 Deductions for non-performance will be based on the unit pricing as submitted by bidder or on the actual fair market cost to the government of the services.
5.2.2 (RESERVED)
5.3 Inspections will be performed by the COR on a periodic and monthly basis. All deficiencies will be noted and the contractor notified.
5.3.1 Periodic inspections will be conducted by the COR to insure full compliance with contract specifications. Deficiencies noted will be called to the attention of the contractor and must be remedied as directed by the COR. Failure of the contractor to perform work satisfactorily when scheduled or to make up scheduled work when so directed will result in deductions from the monthly payments in accordance with Paragraph 5.2.1.
5.3.2 Monthly "walkthrough" inspection of the facility will be conducted by the COR and other appropriate FAA representatives. Attendance by the Contractor's Project Manager is mandatory. Deficiencies will be noted and work rescheduled as directed by the COR. Deductions from the monthly payments for work not accomplished will be made in accordance with Paragraph
5.2.1. Any repeat deficiencies found on the "walkthrough" will result in deductions from monthly payment.
